Masla’h Kutta Ki Khaal Aur Badey Wa Chhotey Raafzi Shia’ Wa Ahl-E-Hadees (Naam Nihaad) Ke Aitrazaat Ke Jawabaat

DARINDAH KI KHAAL KE ISTE’MAAL KA MASLA’H

 SHIA’ RAAFZI KA AITRAAZ AUR IBN-E-TAYMIYAH (Rahmatullahi alaih) KA JAWAAB:

Jab Shia’ Raafzi ne Aitraaz kiya ke, Qiyaas ki wajah se Ahl-e-Sunnat La-Te’daad Amoor Qabeehah me Giraftaar ho gaye hain aur Ye masla’h naqal kiya ke KUTTEY KI KHAAL PEHAN KAR NAMAZ PARHNA JAYEZ HAI.

To Allamah Ibn-e-Taymiyah (rahmatullahi alaih) ne Us Raafzi Shia’ ko Jawab dete hue farmaya:

“Ulema’ ki Ek Jama’t ka Khyaal hai ke HADEES NABAWI (sallallahu alaihi wa sallam)

ایما اھاب دبغ فقد طھر

[صحیح مسلم- کتاب الحیض- باب طھارۃ جلود المیتۃ بالدباغ]

Ya’ni “Jis KHAAL ko bhi DIBAGHAT di Jaaye Wo PAAK ho Jaata hai” ke Umoom (Aam) ke Peish-e-nazar KUTTEY ka Chamraa bhi DIBAAGHAT se PAAK ho Jaata hai, Agar Shia’ se Iski HURMAT ki DALEEL Talab ki Jaaye to Bata Na Sakega…..” [Al-Muntaqaa min Minhaajus Sunnah An-Nabawiyah, Mutarjum Prof. Ghulam Ahmed Hareeri page 239]

CHHOTEY RAAFZI (NAAM NIHAAD) AHL-E-HADEES KE AITRAZAAT:

Daur-e-Bartaniyah (British ke daur me) Angrezon ko Khush karne ke liye Jab Firqa (Naam Nihaad) Ahl-e-Hadees (Asal me Ahl-e-Khabees) ki bunyaad (Foundation) rakhi gayi to Unhoney dekha ke Unke Aaqa’-e-Ni’amat Kuttey (DOG) se bada Pyaar karte hain to (Naam Nihaad) Ahl-e-Hadees ne bhi Kuttey ki SHAAN me Qaseedah Khwaani shuroo’ Kar di.

Ghair-Muqallid, Ibne Hazam ne Ye likha ke Kutta Hiba (gift) me dena Jaayez hai balke Biwi ko Haqq Mehar me bhi Kutta dena Jayez qaraar diya. [Al-Muhalla]

Ghair-Muqallid, Nawab Siddeeq Hassan Khan ne to Poori Tafseel se likha ke, Kuttey ke Gosht, Haddi, Khoon, Baal, Paseenah me se Kisi ki Nijaasat sabit Nahi. [Badrul Ahillah pg16]

Aur Ghair-Muqallid, Allamah Waheeduz Zama’n ne to Kuttey ke Peishaab ko bhi PAAK keh diya.[Hadyatul Mehdi 3/78]

NOTE: Fiqh-e-Hanafi ki Kitab HIDAAYAH ke Khilaaf me Ghair-Muqallideen ne Fiqh-e-Muhammadi ke Naam se HADYATUL MEHDI likhi.

Kuttey aur Khinzeer ke lu’aab ko bhi PAAK qaraar diya gaya. [Nuzoolul Abraar 1/49, 50]

Kuttey ke Paakhaane ko bhi Raajeh Qoul me PAAK Qaraar diya gaya. [Nuzoolul Abraar 1/49]

(Naam Nihaad) Ahl-e-Hadees ne [Fiqh-e-Muhammadiyah] ke Naam se Rasoolullah (sallallahu alaihi wa sallam) ko Jo BADNAAM kiya to phir In Ibaraton par Logon ne Ye Sawaal kiya ke Agar Aap Log Sachche Ahl-e-Hadees hain (Naam Nihaad) Nahi hain aur Ye sab Rasoolullah (sallallahu alaihi wa sallam) se saabit hain to In masaa’il per Ek-Ek Sareeh aur Saheeh Hadees laayein ke Kuttey ka Gosht, Haddi, Khoon, Paseenah, Paakhanah, Peishaab, Lu’aab sab Kuch PAAK hai, to Wo Jawaab Khud Hadees se Peish Na Kar sake aur phir La-Jawaab ho kar Waswasah Andaazi par utar aaye aur Fiqh-e-Hanafi me Kuttey ke muta’lliq Jitni bhi Ibaratein aayi hain Unko Peish kar ke ANGREZON ke daur se le kar ab tak Logon ko GUMRAAH Karne ke Mission per Gaamazn hain.

Chunacha Is daur ka Mash’hoor Fitnah parwar Aalim Talibur Rahman ne Ummat-e-Muhammadiyah me Inteshaar phailaane ke liye Ek Kitab likhi Jiska Naam rakha [KYA FIQH-E-HANAFI QUR’AN WA HADEES KA NICHOR HAI.?]. To Alhamdulillah Iske Jawab me Humne [JI HAAN FIQH-E-HANAFI QUR’AN WA HADEES KA NICHOR HAI.] likhi hai.

 AITRAAZ:

 ISLAM AUR DARINDAH KI KHAAL:

Rasoolullah (sallallahu alaihi wa sallam) ne Darindo ki Khaal ke Iste’maal se mana’ farmaya. [Abu Dawood]

FIQH-E-HANAFI AUR KUTTE KI KHAAL:

Ab Ahnaaf ki Raa’i sun lein. Sahab-e-Hidayah likhte hain:

1. Har Khaal Dibaghat se PAAK ho jati hai, Us par Namaz aur Uske Zariye Wuzoo Karna Jayez hai sivaaye Aadmi aur Khinzeer ki Khaal ke.

Phir mazeid farmate hain:

2. Jis Janwar ki Khaal Dibaghat se Paak ho jati hai, Usey Zubah karne se bhi PAAK ho jati hai, isi tarah Uska GOSHT bhi PAAK ho Jata hai aur Ye SAHEEH hai.

Isi tarah [RADD AL-MUKHTAR] me hai.

3. Hamare Mashaa’iq ne farmaya hai: Jo is haalat me Namaz parhe ke Uski Aasteen me Kutte ka Pilla ho to Aisi Soorat me Namaz parhna Jayez hai. Faqeehah Abu Ja’far Hindwani ne Ye Shart lagayi hai ke Kutte ka munh Bandha hona Chahiye.

Isi tarah [Durr-e-Mukhtar] me hai.

4. Imam Abu Haneefah (rah.) ke nazdeek Kutta NAJAS AL-AYN Nahi aur Isi par FATWA hai aur Agarcha ba’z ne Iski NAJASAT ko TARJEEH di hai Jaisa ke Ibn Al-Shahnah ne zikr kiya. Lihaza Kutta Farokht kiya Ja sakta hai, Ujrat par diya Ja sakta hai. Usey Zamanat ke taur par rakha Ja sakta hai Uski Khaal ki Jaa’i Namaz banayi Ja sakti hai aur Pani nikaalne ka DHOL bhi. Isi tarah Kunwei’n se Kutte ko bahar Zindah nikaala aur Agar Uska munh bahar ho to Pani PAAK hai aur KAPRE bhi PAAK hain Jab tak ke Uska Lu’aab Kapron par Na lage aur Usko utha kar Namaz parhne wale ki Namaz ho Jati hai chaahe Kutta bada hi Kyon na ho. [Page No.s 45, 46]

AL-JAWAAAB:

Hum Pehle Ye Sabit karenge ke DIBAGHAT dene ke ba’d KHAAL PAAK ho Jati hai Phir HIDAYAH aur RADD AL-MUKHTAR ki Wizahat Karenge.

 DARINDAH KI KHAAL KE ISTE’MAAL KA MASLA’H

Imam Muslim (rah.) ne Apni SAHEEH, KITABUL HAIZ me Ek Baab Qayem kiya hai, IS BAARE ME HAI KE MURDAH JANWAR KI KHAAL DIBAGHAT SE PAAK HO JATI HAI.

Is Baab me Imam Muslim (rah.) ne 8 Ahadees Naqal ki hain Jin se Saabit hota hai ke DIBAAGHAT se KHAAL PAAK ho Jati hai.

HADEES# 1:

Ibne Abbas (raz.) se rivayat hai ke Maimunah (raz.) ki Laundi ko Kisi ne Ek BAKRI Sadqe me di, Wo Mar gayi. Rasoolullah (sallallahu alaihi wa sallam) ne Usko Pada hua dekha to Farmaya Tumne iski Khaal kyon na li.? Dibaghat kar ke Kaam me laate. Logon ne kaha Ya Rasoolullah (sallallahu alaihi wa sallam) Wo Murdaar thi. Aap (sallallahu alaihi wa sallam) ne farmaya MURDAAR KA KHANA HARAAM HAI.

HADEES# 2:

Ibne Abbas (raz.) se rivayat hai ke Maimunah (raz.) ne Un se bayan kiya “Rasoolullah (sallallahu alaihi wa sallam) ki Ek Biwi (raz.) ke Ghar me Ek Janwar paala tha wo Mar gaya to Aap (sallallahu alaihi wa sallam) ne farmaya: Iski Khaal kyon na li.? Isko Kaam me Laate.”

 HADEES# 3:

Abdullah bin Abbas (raz.) se rivayat hai, Maine Rasoolullah (sallallahu alaihi wa sallam) se suna Aap (sallallahu alaihi wa sallam) farmate the: JAB KHAAL PAR DIBAGHAT HO GAYI TO WO PAAK HAI.”

HADEES# 4:

Abul Khair se rivayat hai Maine Ibne Wa’la ko Ek Posteen (Chamrey ki Qamees ya Coat) pehne dekha, maine usko chhua. Unhone kaha, Kyon Chhoote ho.? Maine Abdullah se kaha ke Hum Maghrib ke Mulk me rehte hain Wahan barbar ke Kafir aur Aatish parast bohat hain. Wo Bakri laate hain Zubah kar ke, Hum to Unka Zubah kiya hua Janwar nahi khaate aur Mushkein laate hain un me Charbi daal kar. Abdullah bin Abbas (raz.) ne kaha: Hum ne Rasoolullah (sallallahu alaihi wa sallam) se Isko poocha. Aap (sallallahu alaihi wa sallam) ne farmaya: DIBAGHAT SE PAAK HO JATI HAI (Ya’ni Khaal par Jab Dibaghat ho gayi to Wo PAAK hai agarcha KAFIR ne Dibaghat di ho).

 HADEES# 5:

Ibne Wa’la se rivayat hai, Maine Abdullah bin Abbas (raz.) se poocha: Hum Maghrib ke Mulk me rehte hain. Wahan MAJOOSI (Aatish Parast) Mushkein le kar aate hain PAANI Ki, Unme Charbi padi hoti hai to Unhone kaha Kha pee lo. Maine Kaha: Kya Tum Apni Raa’i se kehte ho.? Unhone Kaha: Maine Rasoolullah (sallallahu alaihi wa sallam) se suna Aap (sallallahu alaihi wa sallam) farmate the ke: DIBAAGHAT SE KHAAL PAAK HO JATI HAI.

Qaara’een-e-Kiraam! Humne sirf MUSLIM SHAREEF hi ki 5 Rivaayaat Naqal ki hain.

Is masla’h par Be-shumaar Ahadees Kutab Ahadees me maujood hain. Jinse Saabit hota hai ke DIBAGHAT se KHAAL PAAK ho Jati hai.

HADEES# 6:

Ibne Abbas (raz.) se rivayat hai ke, “Rasoolullah (sallallahu alaihi wa sallam) ne MURDAAR Ka Sirf GOSHT (Khaana) HARAAM farmaya hai aur Baqi Khaal aur Baal aur Oon (ke Iste’maal) ka Kuch Harj Nahi hai.” [Darqutni, Baab Ad-Dibaagh]

HADEES# 7:

Hazrat Sauban (raz.) se rivayat hai Rasoolullah (sallallahu alaihi wa sallam) Jab Kahee’n Safar ka Iradah farmate to Ghar ke Sab Admiyo me Hazrat Fatimah (raz.) se Aap ki Akhri Baat Cheet hoti aur Jab Aap (sallallahu alaihi wa sallam) Safar se tashreef laate to (sab se) Pehle Fatima (raz.) se Mulaqaat karte.

Aap (sallallahu alaihi wa sallam) Ek JUNG se wapas Tashreef laye aur Fatima (raz.) ne Apne Darwazah par Pardah ya Taat latkaya tha aur Hasan wa Hussain (raz.) dono ko Chaandi ke 2 Kangan pehnaaye the. Aap (sallallahu alaihi wa sallam) ne Jo Tashreef la kar dekha to Ghar me Aap (sallallahu alaihi wa sallam) na aaye to Fatimah (raz.) ne Gumaan kiya ke Aap ko Ghar me Tashreef laane se in Cheezon ne roka, daryaft kiya to Yehi ma’loom hua.

Fatimah (raz.) ne Darwazah se Pardah nikaala phir Dono Sahabzaadon se Us Zewar ko bhi utaar liya aur Kaat kar unke saamne daal diya. Dono ke Dono Rasoolullah (sallallahu alaihi wa sallam) ke Paas Rote hue chale gaye. Aap (sallallahu alaihi wa sallam) ne Unse wo Kate hue Tukre le kar farmaya: Ae Sauban! Ye Ja kar fala’n Ghar walon ko de aao. Phir farmaya: Ye Log Mere Ahle-Bayt hain. Main Bura Jaanta hoon ke Ye Apne Maze Dunya hi me Loot lein, Ae Souban, Fatimah ke liye Ek Haar Pathon ka Khareed le aur 2 Kangan HATHI DAANT ke. [Abu Dawood]

Allamah Waheeduz Zaman Ghair-Muqallid iske Faaydah me likhte hain: Is Hadees se ma’loom hua ke Hathi Daant PAAK hai aur Iska Iste’maal Durust hai. BUKHARI me hai Ulema’-e-Salaf is se Kanghi karte the aur isme Teil rakhte the. [Abu Dawood Mutarjam 3/298]

IS HADEES SE SABIT HUA KE MURDAAR KI HADDI PAAK HAI. HATHI AUR KUTTA DONO HARAAM HAIN PER JAB HATHI KI HADDI PAAK HAI TO  PHIR KUTTEY KI HADDI BHI PAAK HAI.

HADEES# 8:

Sayyidah Saudah (raz.) se rivayat hai ke Hamari Ek Bakri Mar gayi. To Humne Iski Khaal ko Dibaghat diya phir Hum Isme Hamesha NABEES (Khajoor ka Meetha Pani) banaate hatta ke Wo PURAANI ho gayi. [Nisaa’I Shareef]

HADEES# 9:

Salmah bin Muhbiq se rivayat hai ke Nabi (sallallahu alaihi wa sallam) ne Ghazwa Tabawwuk me Ek Aurat se Pani mangwaya. Us Aurat ne Arz kiya ke, Mere Paas Paani to Murdah Janwar ki Mushk me bhara hua hai. Aap (sallallahu alaihi wa sallam) ne daryaft farmaya: Kya Tu ne Iski Dibaghat ki thi.? Us Aurat ne Arz kiya: Haan! Nabi (sallallahu alaihi wa sallam) ne farmaya: To Ye DIBAGHAT se PAAK ho gayi. [Nisaa’I Shareef]

EK MASLA’H KI WIZAHAT:

Ab Masla’h reh jata hai ke DIBAGHAT Kis Kis Cheez ke sath di Ja sakti hai aur Iska Tareeqah kya hai.? Iska aam Feham aur Aasaan Jawab Ye hai ke Jis Cheez se bhi DIBAGHAT hasil ho Jaye, Us se Dibaghat dena DURUST hai aur Jis tarah Aasani ho Wo Tareeqah Iqtiyar karna Chahiye. ASAL CHEEZ DIBAGHAT DENA HAI.

AHADEES me ba’z Cheezon ka Zikr bhi milta hai. Jaisa ke Imam Nisaa’i (rah.) ne Ek BAAB baandha hai MURDAAR KI KHAAL KO KIS CHEEZ SE PAAK KIYA JAAYE. Phir Maimunah (raz.) ki HADEES NAQAL ki hai.

HADEES# 10:

Maimunah (raz.) se rivayat hai ke Rasoolullah (sallallahu alaihi wa sallam) ke saamne QURAYSH ke ba’z Log nikle aur wo Ek Bakri ko Gadhe ki tarah Ghaseet rahe the. Rasoolullah (sallallahu alaihi wa sallam) ne farmaya: Agar Tum iski Khaal utaar lete to Achha hota. Unhone Arz kiya: Ye Murdaar hai. Aap (sallallahu alaihi wa sallam) ne farmaya: Ise PANI aur QARAZ Paak wa Saaf kar deta hai.

NOTE: QARAZ Ek Ghaas ya Chhaal hai Jis se Chamra ko Dibaghat dete hain.

HADEES# 11:

Imam Bukhari (rah.) Naqal karte hain..

“Hamaad ne Kaha Murdaar Parinde ke Par me Koi Harj Nahi.” [Bukhari, Kitabul Wuzoo]

HADEES# 12:

Hamaad se rivayat hai ke Murdaar ki Oon Iste’maal karne me Koi Harj Nahi, lekin Isko Dhoya Jayega aur Murdaar ke Par me Koi Harj Nahi. [Musannaf Abdur Razzaq pg206]

HADEES# 13:

Imam Bukhari (rah.) naqal karte hain..

“Aur Zuhri ne Murdaar maslan Hathi waghera ki Haddiyon ke muta’llaq kaha, Maine mutaqaddameen Ulema’ ko paaya Wo Is se KANGHI karte the aur isme Teil rakhte the aur isme Koi Harj Nahi samajhte the.” [Bukhari, Kitabul Wuzoo]

HADEES# 14:

Ibne Abbas (raz.) se rivayat hai, Wo farmate hain ke Nabi Kareem (sallallahu alaihi wa sallam) ne MUSHKEEZAH se Wuzoo karne ka Iradah farmaya to Aap (sallallahu alaihi wa sallam) se kaha gaya ke Ye Murdaar Janwar ka hai. Aap (sallallahu alaihi wa sallam) ne farmaya ke: Isko Dibaghat dene se Iski GANDAGI, NAJAASAT aur PALEEDI door ho Jati hai. [Sahih Ibne Khuzaimah Raqam#114, Sunan Kubra Bayhaqi Raqam#451, Musnad Ahmed Raqam#2117]

Ta’jjub hai (Naam Nihaad) Ahl-e-Hadees TALIBUR RAHMAN ko Khyaal Nahi aaya ke Main Ye Aitraaz FIQH HANAFI par Kar raha hoon Ya Rasoolullah (sallallahu alaihi wa sallam) par..?

FIQH-E-HANAFI ne Wahi kaha hai Jo Rasoolullah (sallallahu alaihi wa sallam) ne farmaya hai. DIBAGHAT ki Shart Aam hai har Murdaar ke liye chaahe wo Paaltoo ho Ya phir Darindah Koi Takhsees Nahi hai.

Phir agar Ye Ganda Masla’h hai to SHARM KARO ke Iski Nobat Kahan tak Pohnchti hai.?

Aap ke Allamah Waheeduz Zaman ne Kutte, Darinde, Bheirye to Ek taraf KHINZEER ki Khaal ko bhi DIBAGHAT se PAAK rakha hai.

FUQAHA-E-AHNAAF ne to Insan ko Uski AZMAT ki wajah se aur Khinzeer ko Uske NAJAS AL-AYN hone ki wajah se Mustashnaa (alag) kiya hai, magar Ye Ghair-Muqallid Hazrat to isko bhi Mustashnaa Nahi karte.

Chunacha likhte hain: “Jis Khaal ko Dibaghat di Jaye PAAK ho jata hai. Misaanah aur Ojri me bhi isi tarah hai. Hamaare ba’z As’haab ne KHINZEER aur AADMI ko Mustashna kiya hai. Haalaanke SAHEEH Ye hai ke Ye bhi MUSTASHNA Nahi.” [Nuzoolul Abraar 1/29]

ZABAH KARNE SE PAAKI HAASIL HOTI HAI:

Maslak-e-Hanafiyah me Haiwanaat ka GOSHT Khaana to Har tarah se HARAAM hai par Agar In Janwaron ko BISMILLAH, ALLAHU AKBAR Keh kar ZABAH kar lein to Unki NAJAASAT Jaati rahegi Albatta HURMAT (HARAAM) Inki ba-dastoor baqi rahegi.

So agarcha Is masla’h ko Tasleem (qubool) karna Awaam ki Tabiyat ke khilaf hai par Jab Qur’an wa Hadees ki Janib dekha Jaye to Ye masla’h Qaabil-e-Tasleem ma’loom hota hai.

Chunacha Allah Subhana wa Ta’la ka irshaad hai:

وَٱلۡمُنۡخَنِقَةُ وَٱلۡمَوۡقُوذَةُ وَٱلۡمُتَرَدِّيَةُ وَٱلنَّطِيحَةُ وَمَآ أَكَلَ ٱلسَّبُعُ إِلَّا مَا ذَكَّيۡتُمۡ

“….Tum par Haraam kiya gaya Gala Ghhot kar mar jane wala Janwar, Chot kha kar mar jane wala Janwar Ya Balandi se Gir kar mar Jane wala Janwar aur Seengo se Lad bhid kar mar jane wala Janwar aur Darindah ka Phaara hua Janwar MAGAR JISKO TUM ZABAH KARLO (Ya’ni Zabah kiya hua Janwar Halal hai)” [Surah Ma’idah: 3]

Is Aayat ko Naqal karne se Maqsood Ye hai ke Allah ta’la ne Is Aayat me ZABAH Karne ko TAZKIYAH (PURIFICATION) se Ta’beer farmaya hai. Isliye Yahan par Lafz ILLA MAA ZUBAHTUM (إِلَّا مَاذُبَحْتُمْ) ke bajaaye ILLA MAA ZAKKAITUM (إِلَّا مَا ذَكَّيۡتُمۡ) ke Alfaaz aaye hain aur TAZKIYAH ko Zuban Arab me “PAAK karne ko kehte hain”.

Is  Maf’hoom ki Daleel me Ahaadees bhi maujood hain.

Chunacha [Nisaa’i Shareef] me Jo hadees naqal hai Uske alfaaz Yun hain:

النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ ذَكَاةُ الْمَيْتَةِ دِبَاغُهَا 

]سنن نسائی –  باب جلود المیتۃ[ 

TARJUMA’H: Nabi (sallallahu alaihi wa sallam) ne farmaya ke: Murdah Janwar (ki Khaal) Dibaghat se PAAK ho Jati hai.

Is Hadees me Lafz ZAKAATU (ذَكَاةُ) aaya hai Jis se TATHEER (PURIFY) ke ma’na muraad hain, Zabah ke ma’na to Kisi tarah Mumkin hi Nahi.

Isi tarah [Musannaf Ibne Abi Shaibah] me Ek Hadees ke Alfaaz Yun aaye hain.

زكاة الارض يبسها 

TARJUMAH: Zameen ki PAAKI Uska KHUSHK (Dry) ho jana hai.

Isi me Ek aur Hadees ke alfaaz hain:

إذا جفت الارض فقد زكت 

TARJUMAH: Jab Zameen Khushk ho gayi to Wo PAAK ho gayi.

In chand Ahadees se sabit hua ke ZAKAATU (ذَكَاة) ke ma’na HAQEEQI TAT’HEER (PURIFY) karne ke hain.

So Jab Allah Ta’la ne ZABAH ko ZAKKAITUM (PAAK KARNA) Kaha hai to Ma’loom hua ke Janwar ko Allah ke Naam par Zabah karna Us ke GOSHT-POST Ko PAAK kar dena hai.

Aur Jis Janwar ko bhi ZABAH kiya gaya hai Uski KHAAL BE-DIBAGHAT bhi Shari’an PAAK hai ba-shart Ye ke Us Janwar ke andar ki Ratoobaat Jo ke NAJAS hain Us par Lagi hui Na ho.

AUR MURDAH JANWAR CHOUNKE BA-NAAM ALLAH TA’LA ZABAH NAHI HUA THA TO USKA TAMAAM GOSHT NA-PAAK HI REHTA HAI, ISLIYE MURDAH JANWAR KI TAT’HEER (PURIFICATION) KE LIYE DIBAGHAT KI SHART HAI.

Isliye Murdah Janwar ki Khaal ko bila Dibaghat iste’maal Ko NA-JAYEZ qaraar diya gaya hai. Chunacha [Nisaa’i Shareef] me aaya hai.

لَا تَنْتَفِعُوا مِنْ الْمَيْتَةِ بِإِهَابٍ 

سنن نسائی – باب مَا يُدْبَغُ بِهِ جُلُودُ الْمَيْتَةِ 

TARJUMA’H: Murdah Janwar ki Kachchi Khaal se Nafa’ (faydah) Na Uthaao.

Jis Janwar ka NAJAS AL-AYN hona Kisi Daleel Shara’i se sabit ho Jaye to Wo Albattah Kisi tarah Qaabil-e-Tat’heer Nahi ho sakta Khwaah Usko Ba-Naam Allah Ta’la Zabah karein Ya Uski Khaal ko Dibaghat dein, NA-PAAK ka NA-PAAK rahega. So Tamam Janwaron me se sirf KHINZEER Ka NAJAS AL-AYN hona Sabit hua hai kyonke Uske baare me Aayat FA INNAHUU RIJSUN Nazil hui hai Jiska Khulasah Ye hai ke Wo Saraasar NA-PAAK MUJASSAM hai aur KHUSHK(DRY) hone se bhi PAAK Nahi ho sakta. Iski Misaal Aadmi ke PAKHANAH Jaisi hai, Ye Khushk hone par bhi PAAK Nahi ho sakta.

Kutta, Bheirya, Bandar, Billi, Sheir wa Hathi waghera Ye sab HARAAM hain Par Inka NAJAS AL-AYN hona Kisi DALEEL SHARA’I se sabit Nahi hai. Balke Jaise Mari hui Gaa’i, Hiran wa Bakri waghera Haraam hain aise hi Ye Haiwanaat bhi Haraam hain so Jaise Wo Dibaghat se PAAK ho Jate hain, Ye Janwar bhi Dibaghat se PAAK ho Jayenge.

Jab Inki Khaal DIBAGHAT se PAAK hui to BA-NAAM ALLAH TA’LA se Ba-darjah Aula Unki KHAAL PAAK ho Jayegi aur Ye oopar Sabit kar diya gaya hai.

Ab KHAALON Ke PAAK hone se Ye Muraad Nahi hai ke Khwaah Makhwaah Aisi Khaalon ki Jaa’inamazein banaya karein aur Phir Us par Namazein parha Karein balke muraad Ye hai ke Agar Kisi ne LA-ILMI se Ya aur Kisi wajah se Kuttey ki Khaal par Namaz Parh li to Uski Namaz ho Gayi.

Par deedah wa daanista Us Khaal par Namaz Nahi parhni Chahiye kyonke Awwal to Kutte ki Dinarat wa Hiqarat isi qaabil hai ke har Lateeful Mizaj Us se Nafrat kiya kare aur Aisi Gandi baton se bacha kare.

Doosra Ahadees se bhi Julood Sabaa’ (Darindon ki Khaal) ki KARAAHAT ma’loom hoti hai kyonke Sheir ki Khaal ke iste’maal se Ra’oonat wa Takabbur, mizaaj me samaa jata hai aur Kutte ki Khaal ke iste’maal se Dinaarat wa Hirs Jee me Aa jati hai.

Chunacha Hadees Shareef me aaya hai ke, Rasoolullah (sallallahu alaihi wa sallam) ne Darindo ki Khaal ke Iste’maal se mana’ farmaya. [Abu Dawood, Nasa’i]

Is Hadees ko Talibur Rahman ne FIQH-E-HANAFI ke khilaf sabit karne ki Koshish ki hai. Asal me is Hadees me Isti’maal ki mumaani’at hai Ya’ni DARINDON Ki Khaal ka Isti’maal karna MAKROOH hai Lekin Is se NAJAS AL-AYN hone ki Daleel pakadna Talibur Rahman ki Jihalat hai.

MAMNOO’ HONA EK CHEEZ HAI AUR USKA NAJAS HONA EK CHEEZ HAI.

Kisi Cheez se mumaani’at (Iste’maal se mana’) ka Ye matlab to Nahi ke Wo NAJAS hai. Kayi misaalein Is Ta’lluq se peish ki Ja sakti hain Jaisa ke Mard ke liye Sona pehanne ki Mumaani’at hai Agar Mumani’at se Sona (GOLD) Najas ho gaya hai to phir Aurtein Is NAJASAT ko Kyon kar pehan rahi hain.? Isi tarah Surkh Rang (Red Color) ka Kaprey pehanne ki mumani’at hai. Aurtein Is NAJASAT ko phir Kyonkar pehan rahi hain.?

(Naam Nihaad) Ahl-e-Hadees, doosron ko Jaahil kehte kehte to Khud Sab se bade JAAHIL Nazar aa rahe hain.

DARINDON KI KHAAL PER NAMAZ PARHNA KI HAQEEQAT:

To Sabit hua ke ZIKRULLAH aur DIBAGHAT se Haiwanat ki Khaalein PAAK ho Jati hain par Is se Ye Koi Na samjhe ke Khwaah makhwaah Us par Namaz parha Karein Ya Uski Khaal ka Iste’maal Wuzoo ke Pani ke liye Karein.

Iski Aisi misaal hai ke Agar Koi Aalim Kisi Aali Faham Ghair-Muqallid ko Ye masla’h bata de ke Agar Koi Shaqs Zameen par Peishaab karde aur phir Wo Zameen Khushk (dry) ho Jaye to Wo PAAK ho jati hai. To Wo Aali Faham Ghair Muqallid Ye Samajh baithega ke Khwaah Makhwah MASJID ke FARSH ko Peishab se Tar karna Jayez wa Durust hai, Khushk ho kar Apne Aap PAAK ho Jayega, Isme Kya Darr hai. Bilkul Aisa hi Haal KUTTEY Ki Khaal ka hai. Humne Masla’ bataya to Aali faham Ghair-Muqallideen samajh baithe hain ke KUTTEY KI KHAAL Ki Jaa’iNamazein hi bana kar Namazein parhi Jaayein, Kuttey ko Goad me le kar hi Namaz parhi Jaaye Ya phir Kuttey ki Khaal se bane Dhol me maujood Pani se hi Wuzoo kiya Jaaye. Ye to Sareeh JIHAALAT kehlaayegi. Aisi KAM-FAHMI, KUJ-FAHMI wa BAD-FAHMI (Naam Nihaad) Ahl-e-Hadees ko hi MUBARAK!!

HAIWANAAT me NA-PAAKI Ba-wajah KHOON ke hai Murdah Janwar me KHOON behta Nahi hai isliye Uska Gosht post PAAK Nahi hota aur DIBAGHAT Shart hoti hai. Aur Haiwanaat ko ZABAH Kiya jata hai to Uske Gosht post se Ratoobaat bahar Nikal Jati hain to La raib wo PAAK ho Jaata hai..

Ab (Naam Nihaad) Ahl-e-Hadees, ZABAH se TATHEER (PURIFICATION) haasil hone me SHAKK wa SHUBA’H me hain to Isme Hum Kya kar sakte hain. Wo Khud hi Anjaane me Ya phir Jaan boojh kar Qur’ani Aayat ke MUNKAR ban rahe hain. Allah Ta’la Aise Logon se Hamaari Ummat ki Hifaazat farmaye. Aameen.

RADD AL-MUKHTAR KI IBARAT KI WIZAHAT:

Ye baat Pehle Guzar Chuki hai ke KHINZEER ki Khaal Kisi haal me bhi PAAK Nahi hoti chaahe Usey DIBAGHAT dein Ya Na dein Kyonke KHINZEER NAJAS AL-AYN hai Ya’ni Wo PEISHAB WA PAAKHAANAH ki tarah Andar bahar se NAJAS hai. Iske ilawah doosre HARAAM JANWAR NAJAS AL-GHAIR hain ke Inki Zaat Peishaab wa Paakhanah ki tarah NAJAS NAHI. Balke Unki ZAAT ooper se PAAK hai. Albatta Inki ANDROONI Ratoobaat NAJAS hain. Aur Is a’itebaar se INSANO aur HALAAL JANWARON ka bhi Yehi Hukm hai. Inka ooper wala Jism PAAK hai magar Andar ki Ratoobaat NAJAS hain. Aur Jab tak Andar wali NAJAS Ratoobat ka Asar Jism ke ooper Zaahir Na ho Wo Jism PAAK Shumaar hota hai aur Androoni NAJAS Ratoobat ka Asar Jism ke ooper 2 Soorton me Zaahir hota hai.

Ek to Maut ke ba’d, Kyonke Maut ke ba’d Insan ho Ya Haiwan Sab ka Jism NAJAS Shumaar hota hai. Yehi wajah hai ke Hauz wa Kunwaa’n Jaise Kutte ke marne se NAJAS ho jata hai. Isi tarah Agar isme Koi Aadmi gir kar Mar Jaye Tab bhi NAJAS ho jata hai.

Doosra Ye ke Androoni Najasat Jism se bahar nikal aaye to Wo Jis Cheez par Lag jaaye wo Cheez NAJAS ho Jayegi. Jaisa ke GHILAZAT Insan ke andar maujood hai. Magar Insan PAAK Shumaar hota hai. Lekin Jab wahi Najasat Insan ke Jism se nikal kar Uske Apne Jism par Ya Kisi doosri Cheez par Lag Jaaye to Wo Cheez NA-PAAK ho Jati hai.

Yehi haal HALAL WA HARAAM Janwaron ka hai ke Agar Androoni Najasat Unke Jism ke Oopar Lag Jaaye to Wo Jism NAJAS hoga warna PAAK hai. Rahi Un Janwaron se Tiba’i KARAAHAT to Wo Doosri Cheez hai.

Ye Nuktah Malhooz khatir rahe ke Haraam Janwaron ki Ratoobaat me se PEISHAB, PAKHANAH, KHOON, PASEENAH, THHOOK, LU’AAB (RAAL) NAJAS hain. Jab ke Insano aur Halaal Janwaron ki Ratoobaat me sirf PAKHANAH, PEISHAAB aur KHOON NAJAS hain baqi PAAK hain.

Is Guftugoo ke ba’d Zeir Ghour masla’h ka samajhna Koi Dushwaar Nahi ke Kutta ZINDAH ho aur Us ke Jism ke ooper Koi doosri NAJASAT Lagi hui Na ho aur Us pas PASEENAH bhi Na ho To Uska Jism Ooper se PAAK hai. Rahi Androoni Najasat to Jab tak wo Andar hai Uska Asar Jism ke ooper Zaahir Nahi hota.

Isliye agar Koi Shaqs Namaz me Kutte ka Pilla (Chhota Bachcha) Utha le ba-shart ye ke Uske Jism ke ooper NAJASAT Na lagi ho aur Uska Munh baandha hua ho taa ke Uska THHOOK wa LU’AAB Na lage aur Namaz se faarigh hone tak Uski Koi Ratoobat Kapre aur BADAN waghera ko Na lage to NAMAZ JAYEZ hai. Kyonke Koi Cheez Mufsid-e-Namaz (Namaz ko Torne wali) Peish Nahi aayi aur PAAK CHEEZ Amal Kaseer ke baghair Uthaana Namaz ke liye Mufsid Nahi Jaisa ke Rasoolullah (sallallahu alaihi wa sallam) ne Apni Nawasi Umaamah ko Utha kar Namaz Parhi. [Bukhari 1/74]

Ab Ghair-Muqallideen Yahan per bhi Apni Aala Fahmi dikhaate hue Ye Na Samajh baithein ke Khwaah Makhwaah KUTTEY ko GOAD me utha kar Namaz parhi Jaaye. Masla’h to Ye hai ke Agar Kisi ne Namaz Parh li hai to JAAYEZ hai.

DURR-E-MUKHTAR KI EK IBARAT PER AITRAAZ:

Durr-e-Mukhatar me likha hai ke: BHEEGE KUTTEY KI CHHEENTON SE AUR USKE KAATNE SE KAPRA NA-PAAK NAHI HOTA.

(Naam Nihaad) Ahl-e-Hadees ke Ulema’ wa Juhala’ se Hum poochte hain ke Isme Kya SHARA’I QABAHAT hai.? Tum Logon ne Kisi Aayat Ya Hadees ka hawala Peish Nahi kiya.

Ghair-Muqallid Maulvi Waheeduz Zamaa’n ne likha hai:

“Kapra ya Badan, Kuttey ki Chheento’n se NA-PAAK Nahi hota. Na Kaatne se chaahe Uska Lu’aab bhi Kyon Na Lag Jaye.” [Nuzoolul Abraar]

Jab Tumhaare Mazhab me Lu’ab lagne per bhi NA-PAAK Nahi hota hai to Phir Aap Logon ne Apne Maulvi Waheeduz Zamaa’n ke khilaaf Kitne Risaalaat likhe hain.?

Ab Aitraaz karne walon ko Qur’an ke ba’d Sab se Saheeh Kitab, BUKHARI SHAREEF bhi dekh leni Chahiye thi.

Chunacha Imam Bukhari (rah.) ne Apni SAHEEH me Ek Baab bandha hai.

KUTTEY KE JHOOTE AUR USKE MASJID ME GUZARNE KA BAAB

Phir iske ba’d Imam Zuhri (rah.) ka Ek FATWA Naqal kiya hai ke, Imam Zuhri (rahmatullahi alaih) farmaate hain: “Jab KUTTAH Kisi BARTAN me Munh Daal de aur Iske Alaawah Wuzoo’ ke liye aur Paani Na ho to Is Paani se (Jisme Kuttey ne Munh daala) Wuzoo’ kiya Ja sakta hai.”

Hazrat Abu Hurairah (raziallahu anhu), Rasoolullah (sallallahu alaihi wa sallam) se rivayat karte hain ke, Aap ne farmaya: Ek shaqs  ne ek kutta dekha Jo Pyaas ki wajah se Geeli Mitti kha raha tha to, Us Shaqs ne Apna Mozah liya aur Us se (us Kutte ke liye Pani bharne laga hatta ke Usko Sairaab kar diya, Allah ne Us Shaqs ko Is Fa’l ka Ajar diya aur Usey JANNAT me Daakhil kar diya…………. Ibn-e-Umar (raz.) rivayat karte hain ke, Rasoolullah (sallallahu alaihi wa sallam) ke Zamaane me KUTTEY, MASJID me aate jaate the Lekin Log In Jagahon per Pani Nahi chhirakte the.

Phir [Abu Dawood] ki rivayat me Alfaaz kuch is tarah aaye hain:

Hazrat Ibn-e-Umar (raziallahu anhu) se rivayat hai ke, “Main Rasoolullah (sallallahu alaihi wa sallam) ke Zamaane me Raat ko Masjid me raha karta tha aur Main Jawaan aur Kunwara tha aur Kuttey bhi Masjid me aate Jaate the aur Peishaab kar dete the aur Peishab ki wajah se Us per (Zameen per) Paani Na bahaate the.” [Abu Dawood Kitab: At-Tahaarah; Baab: Zameen Khushk ho Jaane ke ba’d PAAK ho Jati hai]

Imam Bukhari ne Is Hadees se Kutte ke Jhoote ki Paaki par Istedlaal kiya hai.

Iske ba’d Shikari Kutte ki Hadees zikr kar ke Isko bhi Uski Paaki ki daleel banaya hai..

Ab Ghair-Muqallideen Jis tarah Fiqh-e-Hanafi per Apne Hath Saaf Kar rahe hain Usi tarah [Bukhari, Muslim, Abu dawood, Nisaa’i] waghera per bhi Apne Hath Saaf kar lete.

(NAAM NIHAAD) AHL-E-HADEES TALIBUR RAHMAN KI JIHAALAT YA KHIYANAT:

Talibur Rahman ko NAJAS AL-AYN aur NAJAS AL-GHAIR ka FARQ Ma’loom Nahi Neiz Ye ke Kutta NAJAS AL-GHAIR hai aur NAJAS AL-GHAIR ka Jism PAAK hota hai Jab tak Koi NAJASAT Na lage to, Ye Uski JIHAALAT hai aur Agar Ye Sab Kuch Ma’loom hone ke ba-wajood Mehaz FIQH DUSHMANI ki wajah se A’itraaz karta hai to Ye Uski KHIYANAT hai.

GHAIR-MUQALLIDEEN SE CHAND SAWALAAT WA MUTAALBAAT:

1. Agar Koi Shaqs Kutte ka Pilla Utha kar Namaz parhe Jis ke Jism par Koi Najasat Nahi, Na Namaz ke darmyan Koi Kutte ki Najasat Namazi ke Badan wa Kapron par Lagi, Na Amal Kaseer hua to Ye Namaz Saheeh hai Ya Faasid hai.? Sareeh Aayat ya Hadees se Jawab dein.

2. Agar Koi Shaqs Ghhori, Gaa’i Ya Bijoo ke Bachche ko Utha kar Namaz parhe to Namaz Jayez hai Ya Na-Jayez.? Sareeh Aayat Ya Hadees se Jawab dein.

3. Bachche ko Utha kar Namaz shuroo’ ki Bachche ne oopar Peishab kar diya, Namaz Saheeh ya Faasid.? Sareeh Ayat Ya Hadees se Jawab dein.

4. Kutte ne Musallaa ke ooper Peishab Ya Pakhanah kar diya to baghair Dhoye Us Par Namaz Jayez hai Ya Na-Jayez.? Sareeh Aayat Ya Hadees se Jawab dein.

5. Kutte ne Masjid me Peishab kar diya to Masjid ka Dhona Zaruri hai Ya Nahi.? Qur’an wa Hadees ki Sareeh Daleel se Jawab dein.

Qaara’een-e-Kiraam! Humne Aqali wa Naqali dalaa’il se saabit kar diya hai ke FIQH-E-HANAFI, QUR’AN WA HADEES KA NICHOR hai. Ab FAISLAH Aap karein ke TAQLEED Karna GUMRAAHI hai Ya Phir (Naam Nihaad) Ahl-e-Hadees ki tarah TAQLEED ko Chhor kar FUQAHA’-E-KIRAAM ke IJTIHAAD Ka Mazaaq Udaana GUMRAAHI hai.

Allah Ta’la se dua hai ke Aise FITNAH BAAZ GHAIR-MUQALLIDEEN se Hamaari Hifazat farmaaye aur Har GUMRAAH ko HIDAYAT de aur Jo HIDAYAT per hain Unko Hamesha HIDAYAT per Qaayem rakhe. Aameen Summa Aameen.
