Bade Wa Chhote Raafzi Shia’ Wa (Naam Nihaad) Ahl-E-Hadees Ki Fiqh Dushmani Aur Masla’h Nasab Ka

Bismillaahir Rahmaanir Raheem

Daur-e-Bartaaniyah me Jab Firqa (Naam Nihaad) Ahl-e-Hadees ki bunyaad rakhi gayi to Inka har FARZ se Aham FARZ ANGREZON ke khilaaf JIHAAD Kar rahe Ulema-e-Ahnaaf ko BAD-NAAM Karna aur  Apne Angrezi  Aqaaon ko Khush karna tha. Isliye Inhone FIQH-E-HANAFI Ko Badnaam karna shuroo kar diya.

FIQH-E-HANAFI ko Qur’an wa Ahaadees ka mukhaalif saabit karne ke liye Daur-e-Bartaniyah me Sab se pehle Shia’ Rawafiz ne pehal ki thi aur HAMID HUSSAIN LAKHNAVI SHIA’ ne Imam Abu Haneefah (rah.) aur Fiqh-e-Hanafi ke khilaf 2 Kitabein likh daali. Phir Ye FITNAH Phailaane ka Kaam (Naam NIhaad) Ahl-e-Hadees ne Apne Zimme le liya aur Shia’ Rawafiz ki Kitabon se Aitrazaat chura kar FIQH-E-HANAFI ke khilaaf Kitabon ka Ek Naya silsilah Shuroo’ kar diya. ANGREZON ke daur se Pehle (Naam Nihaad) Ahl-e-Hadees ka Koi Naam wa Nishaan Nahi tha Isliye FIQH-E-HANAFI ke khilaaf Jitni bhi Kitabein maujood hain Wo Saari ki Saari ANGREZI Daur ke ba’d likhi gayi hain.

SHIA’ RAAFZI KA AITRAAZ AUR IBN-E-TAYMIYAH (Rahmatullahi alaih) KA JAWAAB:

Shia’ Raafzi ne Aitraaz kiya ke: Qiyaas ki wajah se Ahl-e-Sunnat la-te’daad Umoor Qabeehah me giraftar ho gaye. Phir Aitraaz naqal kiya ke..

“Agar Kisi Shaqs ki Beti Mashriq me Sakoonat pazeir ho aur Khud Maghrib me rehta ho, phir wo Maghrib hi me Ghaa’ibanah taur per Kisi Aadmi se Apni Larki ka NIKAAH kar de, 6 Maah baad ke Us Larki ke Yahan bachha paida ho to wo bachha Usi Khaawand ka qaraar diya Jaaye.”

Shaikhul Islam, Allamah Ibn-e-Taymiyah (rah.) apni Kitab [MINHAAJUS SUNNAH] me Us Raafzi ko Jawaab me farmaatey hain ke……

“Mashriq me Sakoonat rakhne wali Aurat ke Bachchey ka Maghribi Aadmi ke Sath Ilhaaq bhi Imam Mausoof (Abu Haneefah (rah.)) ka MASLAK hai aur Doosre A’immah iski Ta’eed Nahi karte.

Darassal Imam Sahab (Rah.) ka Nuqta-e-Nazar Ye hai ke, NASAB KA ISBAAT SIRF MEERAAS (Estate, Property) HAASIL KARNE KE LIYE KIYA JAATA HAI, YE MATLAB NAHI KE WO USKA SULABI (Legitimate) BACHHA HAI.”

Aur aage ye bhi likhte hain ke…

“Agar Ye Fiqahi Masaa’il Ghalat hain to isme Shuba’h Nahi ke Jamhoor A’immah inke Khilaaf hain aur Agar DURUST hain to Aqwaal Ahl-e-Sunnat se Khaarij Na honge.”

Ibn-e-Taymiyah (rah.) ne Kitna Behter Jawaab diya hai, Lekin SHIA’ RAWAFIZ ki ANDHI TAQLEED me (Naam Nihaad) Ahl-e-Hadees Ummat-e-Muhammadiyah (sallallahu alaihi wa sallam) me FITNAH barpa karna chaahte hain.

Agar Imam Abu Haneefah (rahmatullahi alaih) ka Ye Ijtihaad Ghalat bhi hua to Unhein 1 Ajar Zaroor milega aur Agar Ye Masla’h DURUST hai to phir 2 Ajar milenge Ek Ijtihaad ka aur doosra Haqq baat ko Paane ka. Ab Ye Ijtihaad Haqq hai Ya Nahi Isko Hum Qur’an wa Hadees ki Roshni me samajhne ki Koshish karte hain. In sha’ Allah..

Shia’ ki ANDHI TAQLEED karte hue (Naam Nihaad) Ahl-e-Hadees ka Mash’hoor Fitnah parwar Aalim Yusuf Jaipuri ne Apni Kitab [HAQEEQATUL FIQH – NASAB KA BAYAN] me Aitraaz Naqal kiya hai aur Aaj Kal ke Ghair-Muqallid Launday Is Masla’h ko FIQH-E-HANAFI ka Mazaaq Udaane ke liye Social Networking Sites per daalte hain.

“Mard Intehaaye Maghrib me ho aur Aurat Intihaaye Mashriq me itne faasle per ke Dono ke darmyaan Saal bhar ki Raah ho, Kisi tarah Unka Nikaah kar diya gaya, Agar ba’d Taareekh Nikaah ke Aurat 6 Mahine me Bachcha Jane to Ye Bachcha Sabit An-Nasab hoga, Haraami na hoga balke Ye Us Mard ki KARAAMAT samjhi jaayegi.” [Durr-e-Mukhtar 2/140]

AL-JAWAAB:

Bina Tehqeeq ke (Naam Nihaad) Ahle-Hadees me Shaamil Juhala’ Is Aitraaz ko Aam Logon me Phaila kar Ek taraf Allah Ta’la ki NA-FARMANI Kar rahe hain Jiske Wo Allah Ta’la ko Jawab dah rahenge. In sha’ Allah..

Chunacha Allah Ta’la ka irshaad hai, “Aye Eimaan waalo! Agar koi Faasiq tumhaare paas koi Khabar le kar aaye to khoob Tehqeeq kar liya karo (mubaada) ke Kisi Qoum ko Naadaani se nuqsaan pohncha do. Phir Tumhey apne Kiye per Naadim hona parey.” [Surah Hujuraat:6]

يَا أَيُّهَا الَّذِينَ آَمَنُوا إِنْ جَاءَكُمْ فَاسِقٌ بِنَبَإٍ فَتَبَيَّنُوا أَنْ تُصِيبُوا قَوْمًا بِجَهَالَةٍ فَتُصْبِحُوا عَلَى مَا فَعَلْتُمْ نَادِمِينَ

Hazrat Abu Hurairah (raz.) se rivayat hai ke, Rasoolullah (sallallahu alaihi wa sallam) ne farmaya: Kisi Shaqs ke Jhoota hone ke liye Yehi Kaafi hai ke Wo har Suni hui baat ko bayaan kar de. [Saheeh Muslim – Muqaddamah]

كَفَى بِالْمَرْءِ كَذِبًا أَنْ يُحَدِّثَ بِكُلِّ مَا سَمِعَ

Ghair-Muqallid, Yusuf Jaipuri ne Hadees Shareef se Na-Waaqfiyat ki bina per Ya phir Hanafi Fiqh se Zidd wa Inaad ki bina per Shia’ Ki Andhi Jahilana Taqleed karte hue Aitraaz Naqal kiya hai..

1. Hum Ghair-Muqallideen se poochte hain ke Ye masla’ Aakhir Koun se Hukm-e-Qur’ani aur Kis Farmaan-e-Nabawi (Sallallahu alaihi wa sallam) ke khilaaf hai? Ghair-Muqallideen, ne iski wizaahat zaroori Nahi samjhi. Ab AITRAAZ kiya hai to Ghair-Muqallideen ko chaahiye ke is masla’h ke khilaaf Hukm-e-Qur’ani ya Nabawi (sallallahu alaihi wa sallam) peish karein.?

2. Ghair-Muqallido! Zara ghaur kar ke Jawab dena ke oopar bayan kardah soorat me Baap agar bachhe ke Nasb se INKAAR Nahi karta to Aap logon ke paas Kaunsa Shara’i Jawaaz hai ke Aap is se Inkaar karein.? Kyonke NASB to Mard ke Iqraar se hi sabit hoga, Fuqaha’ ne Ye kahan likha hai ke Mard ke Inkaar ke ba-wajood bhi Bachha ka Nasab sabit rahega.?

3. Mash’hoor Hadees me Rasoolullah (sallallahu alaihi wa sallam) ke Ye alfaaz maujood hain.

الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ

Hazrat Imam Al-Aazam Fil Fuqaha’ Abu Haneefah (rah.) se rivayat hai ke Hazrat Umar ibn Khattab (raz.) se marwi hai ke, Rasoolullah (sallallahu alaihi wa sallam) ne irshaad farmaya: “Baccha Faraash (Khaawand) ka hai aur ZAANI ko Sangsaar kiya jayega.” [Musnad Imam-Al-Aazam Abu Haneefah (rah.) – Kitabun Nikah – Baab Maa Jaa’a Fi Annal Walada Lil Faraash]

Ye Hadees Mash’hoor hai. [Bukhari H#6818; Muslim H#3615; Tirmizi H#1158; Abu Dawood H#2284; Nasa’I H#3512; Ibn-e-Majah H#2006]

(Ya’ni Bachha Waalid ka hoga kyonke Aurat uska Faraash (Bichhona) hai aur Zina-kaar ki taraf Bachha mansoob Nahi kiya Ja sakta balke ZAANI ko Patharon se Sangsaar kiya Jaayega)

MAFHOOM-E-HADEES: Ye hadees ek taweel qissah ka aakhri Juzoo hai Jo Saheehain me manqool hai ke Hazrat Sa’d bin Abi Waqas (raz.) ka ek Bhai tha Jiska Naam Utbah bin Abi Waqas tha, Usne marte waqt apne Bhai ko Ye Wasiyat ki ke Zim’a ki Jo Baandi hai, Us se Paida hone waala Bachha mera hai (Goya ke Usne Bad-kaari ka Aitraaf kiya) isliye Uski Zimmedaari Tum Qubool Kar lena.

Fatah Makkah ke mauqe’ per Jab Hazrat Sa’d bin Abi Waqas (raz.) Makkah Mukarramah gaye to Unhoney Us Bachhey ko apne paas bulaaya aur Kaha ke Ye mera Bhateejah hai aur mere Bhai ne is silsiley me Mujhse Wa’dah liya tha, Udhar se Abd bin Zam’ah khada hua aur wo kehne laga ke Ye mera Bhai hai, Mere Baap ki Baandi ke yahan paida hua hai, Jab ye Jhagra barha to Dono Nabi (Sallallahu alaihi wa sallam) ki Khidmat me haazir hue, Dono ne apna apna Mudda’I aur Daleel bayan ki, Nabi (Sallallahu alaihi wa sallam) ne saari Tafseel sunne ke ba’d Abd bin Zam’ah ke HAQQ me Faislah dete hue Irshaad farmaya: “Bachha Bister waaley (Khaawand) ka hota hai aur Zaani ke liye Pathar hote hain.”

Is zaabte ke tehat Fiqah-e-Hanafi ka masla’h Be-ghubaar hai. Isme Aqli Ahtemaal ko dakhal dena darassal Shar’iat ki TAKZEEB karna (Jhutlaana) hai. Rasoolullah (Sallallahu alaihi wa sallam) ki is Hadees ki TAKZEEB karna hai.

4. Baaqi raha ye masla’ ke Kya aisa Mumkin hai? To is se inkaar sirf MUNKAR-E-KARAAMAAT ke Zehan me hi aa sakta hai kyonke FUQAHA’ ne Siraahat ki hai ke Karaamatan KHAAWAND (Shohar) ka Biwi ke paas Ya Biwi ka KHAAWAND ke paas pohanch Jaana Mumkin hai aur Karaamatan MAHEENO wa SAALON ka safar Lamhon me tai kar lene ka SABOOT Qur’an-e-Paak me maujood hai. Suleimaan (Alaihis Salaam) ke Wazeer Asif bin Barkhya (rah.) ne kaha, “Mai Palak Jhapakne ki deir me TAQT-E-BILQEES le aaonga” Chunacha Wo le aaye. Is se sabit hota hai ke Karaamatan aisa Mumkin hai.

Darassal Ye Taaweel, Hadees-e-Shareef ke zaabte (rule) ki taa’eed me Naqal ki gayi hai. Agar Ye Taaweel iqtiyar Na ki Jaaye tab bhi Hadees Shareef ke is Zaabte ke tehat Us bachche ko Haraami Nahi kaha Ja sakta Jabke Khaas kar Zina ka koi Saboot bhi Nahi. Agar Saboot ho jaaye tab bhi Hadees ke zaabte ke mutabiq Bachcha Haraami Nahi hai.

5. Isi masla’h per Behas karte hue Ghair-Muqallid Maulvi Inayatullah Asri farmate hain, “Wo bachcha isliye SAHEEH AN-NASAB hai ke bataur-e-Karaamat, Istiqdaam Al-Jin se dono (Miya, Biwi) ka milaap mumkin hai ke Wo Uske paas gayi hogi Ya Wo uske paas aaya hoga.” [Uyoon Zamzam pg19]

Ghair-Muqallid, Muhammad Joonagadhi Jiska Tarjuma’h kiya hua Qur’an Har Ghair-Muqallid Masjid ki Shaan bana hua hai, Usne Is Hadees per Behas karte hue likha:

“Bachcha Sahab-e-Faraash ko (Ya’ni Khaawand ko) milega. Kyonke Faraash ke amal ka moujab Yehi hai. Pas laazmi hai ke Aap (Sallallahu alaihi wa sallam) ke is hukm aur Fatwe ko Yunhi Tasleem kar liya jaaye.” [Fataawa Nabawi (sallallahu alaihi wa sallam) pg67]

Ghair-Muqallideen ke Sardar Maulana Sanaullah Amritsari to Yahan tak farmate hain ke “Talaaq ke ba’d Iddat me Kisi Ghair se WATI ki to Bachcha Khaawand ka hoga.” [Fataawa Sanaa’iya 2/107]

Lijiye Janab! Ghair Muqallideen ke haan Iddat me bhi Kisi Ghair ke Zina karne ka saboot mil jaaye tab bhi Wo bachcha Haraami Nahi balke apne Baap ka shumaar kiya Jaayega, to Nikaah ki haalat me ba-tareeq Aula Haraami Nahi ho sakta.

6. Haan! Khawand agar Biwi per ZINA ki Tohmat laga kar Bachche ke Nasab se inkaar kare ke bachcha mera Nahi hai to phir Shar’iat ne Khawand Biwi ke darmyaan Li’aan karne ka hukm diya hai. Li’aan ke ba’d wo bachcha Khaawand ka Nahi hoga lekin Maa ka waaris banega aur Maa uski waaris banegi.

[Mishkaat –> Kitabun Nikaah – Baab Al-Li’aan] me Ibne Umar (Raz.) se marwi hai ke Rasoolullah (Sallallahu alaihi wa sallam) ne aise ek Jhagrey me Li’aan ke ba’d Bachcha Maa ke hawale kar diya. [Ba-Hawala Bukhari wa Muslim]

لَاعَنَ بَيْنَ رَجُلٍ وَامْرَأَتِهِ فَانْتَفَى مِنْ وَلَدِهَا فَفَرَّقَ بَيْنَهُمَا وَأَلْحَقَ الْوَلَدَ بِالْمَرْأَةِ

 Ek aur Hadees me hai: Rasoolullah (sallallahu alaihi wa sallam) ne farmaya ke, “Aurat 3 Logon ki Meeraason ko jama’ karti hai, (i) Aazaad kardah Ghulaam ki Meeraas. (ii) aur Luqeet (Lawaris bachcha). (iii) Aur wo bachcha jiski wajah se li’aan kiya hai Aurat ne.” [Sunan Abu Dawood – Kitabul Faraa’iz]

الْمَرْأَةُ تُحْرِزُ ثَلَاثَةَ مَوَارِيثَ عَتِيقَهَا وَلَقِيطَهَا وَوَلَدَهَا الَّذِي لَاعَنَتْ عَنْهُ

Is doosre zaabte se Jo Hadees-e-paak se sabit hai ma’loom hua ke bachche ke Nasab ka Inkaar Khaawand kare to Wo bachcha Sabit An-Nasab Na hoga. Agar Khawand Inkaar Na kare to Wo bachcha Sabit An-Nasab hai. Aur Jaisa ke Ibn-e-Taymiyah (rah.) ne bayaan farmaya hai: Nasab ka Isbaat sirf Meeraas Haasil karne ke liye kiya Jata hai, Na ke Wo Uska SALABI Bachha hai.

Haan! Agar Koi Ghair-Muqallid Shari’at-e-Muhammadiya (Sallallahu alaihi wa sallam) ka inkaar karta hai to Ye uski Apni BAD-NASEEBI hai.

Allah Ta’la In La-Mazhabon se Ummat ki Hifaazat farmaaye. Aameen..
