Firqah e Naam Nihaad Ahele Hadees Ek muhdis (naya) Firqah hai, jis ki umer abhi kuch Ziyadh Nahi Hai, Saah wali Ullah al-azeez sahab Muhaddis e Dehlwi(Reh) aur isha’aq sahab Muhaddis Dehlwi(reh) ke Kaseer Ta’daad Tala Mizh wo Mutalliqeen  main se ek Sahab ne Sabse alag Deedh Anyek ki Masjid  Bana’I, aur Phir Ayesi deedh anyek per mazeed eeinteen badhaa’di gain, is Firqah ne Chend IKHTE’LAAFI Masail ku Sha’nakehth aur alamat bana’I.

Jo Siraat e Mustaqeem se Munharif Hua hai. Rawazif aur Kahwrij se Leker Zama’na e Haal ke Tamaam Firqho main aur Girhoo per Nazer Daal liji’ea ke kise ke paas ( Islaam main poor’e toor se Dakhil ho jaa’o ) ka Program nahi mile’ga. Her ek Apni Apni ek Shana’khath  Bana ker Is Ko Bacha ne ki Her Mumkin Koshi’sh Kertaa hai. Is Terh ek Ayesa mas’ala Jo poor’e Majmue ISLAAM ke Pas’e Manzer main Ziyadh Ahmiyat ka haa’mil Nahi Raha’hai. Haq o Batil ka Imtiyaaz ja’ta hai. Iski Ayesi Misaal hai, Jaise Haath main Paan’ch Ungliyaan hain Qudret ne her ek ki ek Miqdaar Banad’I hai, is Miqdaar main wo Khoob Soorat aur ber Mehel Maloom hoti hain, Laikin in Panch’oo Ungli’oon Main se ek Ungli Ager Gez’bher ki Jaa’ea to wo us Shaks ki Shanaa’kthe ben Jaa’egI, Meger Phoodh aur Bad-soorat, ap Dekh li Jiye Kisi Ne Sahaba Ikraam(Raz) main Chand Makhsoos Ashaab(Rez) ko Chan Kira nahi Bhot Aunchaa Uthaa Diyaa, aur Dusro ko Giraadi’ya Kaeen Gunaah Kabeerh ki Haisi’at ko Uske Maqaam se Buland ker ke use kufr ke ham Paayah(ham-maqaam) Banaker apni Sana’kath Qaem ki Gai. Tafseel ka muqa to nahi hai. Werna her firqah ki ek ek shana’kthe Dikhaai Jaasakti hai.

Firqah Naam Nihaad Ahele Hadees Ne Bhi Chand Juzi Masa’il ko Apni Shan’kthe ban’lia namaz’on main Rafa’yaneen, Ameen bil Jeher, Qirat Khalfal Imam. Aath Rakat, Taraweeh, un Main se Koi mas’ala aai’sa nahi hai Jis per Haq o Batil ka Midraar na ho,

Inhi Alamati Masa’il main ek Ahem Masla Ek Majlis ki Teen Talaqo’n  ka hai, Allama Ibne ta’emiya aur allama Ibne Qayyim(ala’I hir rahma) ne Pheli Mertaba Isi Teen Talaqo’n ko Ek Qaraar Diya Meger Inke Alawa Kisi Alim ne Ise Tasleem Nahi kiya, Is Naa-malood Naam Mihaad Firqah ko Apni Shana’kthe ke’liye ye Masla Pasand Aaya.

Aur Mashoor Ker Diya ke ye Mazhab Muhaddiseen Ka hai aur Iske Khilaaf  Mazhab e Ahnaaf ka hai., Isliye Hamre Ashaab Ise Fauran Tasleem kar Lete hain aur Iske Khilaaf  Ko Rad Kardete hain. Halanke Ye Fatwa Ya mazhab Aathwi Sadi hijri main aya hai,,,,.

Laikin kuch Arseh ke Baad Naam Nihaad Firqah ko Ja’deed Inkeshaaf hua ke Ek Masjlis ki Teen Talaqon ke Hukm Main Aaj Tak Jumhooraat Jis Per Amal Kerte Aa’e Hain Aur Jis Per Wo Khud Amal Kerte Aaye Hain Wo Galat hai.. Sahi wo hai jo Saat sao(700) Saloon Baad Allama Ibne Ta’iymia(Reh) Aur Allama Ibne Qa’iym Ne Us Sil’sile Main Pech kiya.. Jo Asal Rawafizon Ki Alamat Thi..[Fatawa Sunaiya 2 Safa 45 To 46]

Firqh e Naam Nihaad Ka Mu’aqaf Hai ke Ager Koi Shaks Ayek Majlis main Teen Talaq’en De To Wo Ek Hi Waq’e Hoti hai aur Mutallaqa Us ke Liye Haal Hai wo Rujo Hosakta hai.

JUMHOORAAT:  Quran e Kareem Ka Sareeh Hukm, Pas ager Usko (Teen) Talaq Dede To uske Liye Halal nahi hai uske baad jabtet ke wo  (aurat) Dusre se Nikaah na karle.[Sureh Al-Baqrah Ayat no: 230] is ayat ke hokum per amal kate hua Jumhuraat ka Mu’aqaf hai Derje Zail hai..

Ek Majils ki Teen Talaqen Be’ek Lafz Di Jaaye’n Ya ba Lafz Di Jaaye’n Mutaedah  Waqe Hojati Hai. aur Teen Talaq’on ke Baad Cha’he Wo Jis Terha Di Gai Hin Rujuat(wapas hona) Kar’na Sara’an(sharee’at) Mumkin nahi. Sharee’at ka Ye Wo Masla Hai Jis per Ahele Sunn’at Wal Ja’mat Ke her ek Imam Imam e Azam Abu hanifa(Reh) Imam Malik(Reh) Imam Shafa’i(Reh) aur Imam Ahmed(Reh) ka Ittefaaq hai, aur na Sirf Yahi Balke Diger Akabir Aimma e Fiqqah Wo Muhaddiees Masl’an Imam Auza’I(Reh) Imam Nakh’I(Reh) Imam Ishaaq(Reh) Imam Abu Sur(Reh) Imam Buqari(Reh) ka Bhi Yah Qa’ul Hai, Balke Jumhoor e Sahaba(raz) Wo Ta’baeen Wo Taba’tabaeen Wo Aimma e Salaf o Khalaf Isi ke Qa’el hain.

NUKTA IKHTELAAF:  Chunke Firqah e Naam Nihaad ka Mu’aqaf Quran e Kareem Ka Sareeh Hukm, Pas Ager Usko (Teen) Talaq Dede To Uske Liye Halal Nahi Hai Uske Baad Jabtet ke wo (Aurat) Dusre se Nikaah Na Karle. [sureh Al-Baqrah Ayat no: 230] Ke Khilaaf hai. Quran e Kareem  Teen Talaq’en Di Hui Aurat ko Talaqen Dene Wale Per Haram Qarar Deta hai Aur Firaqh Naam Nihaad Use Halal Qarar Dete hain. Isliye Firqah e Naam Nihaad ko Apni Daleel main Nifs(Adhi) Sareeh Ayat(Quran e Kareem ki ayat) Ya kam az kam Ahadees e Sahihi’yah Sareehi’yah Mutawatera Pesh Kerna Cha’hiye..

Mazkurah Riwayat Na Qa’ul e Rasolullah(sallallahu alaihi wasallam) hai Na Fe’l e Rasooullah(sallallahu alahi wasallam) Hai Aur Na Taqreer e rasolullah(sallallahu alaihi wasallam) hai, jab ke Marfu Hadees ki Tareef hai ke,, Jis main Huzur akrem(sallallahu alaihi wasallam) ke Aq’wal o Afa’l aur Taqreer’raat Bayan ho. Isliye ke Mazkura Riwayat s’ire se Marfu hi nahi hai. Usool ki Ruh Se Naam Nihaad  Ahele Hadees ko Halal Ki Daleel Main Ahadees Sahihee’yah Aur Sareehi’yah  Mutawatero Pech karna chhi’ye, Ager se Riwayat Sahi Bhi Hoti to Qbil e Hujjat nahi  Thi kiyun ki Firqah Naam Nihaad Ke Nazdik Gair e nabi(salallahu alaihi wasallam) ka Qa’ul o fa’il Hujjat Nahi hai Jabke ye Riwayat Mutaddad(bhot) se Wjoohaat ki Bina Per Bhi Na Qab’il e Isted’laal hai.

(1) Ye Riwayat Wahen hai Glalat hai chnann’che bade Jalleel ul Qadr hafiz o Muhaddis Ibe Abdul Ber Ne Farmaya: Riwayat Wahem Wo Galat hai [Al-Jawahir Al -Naqi Safa 113]

(2) Ye Riwayat Shaaz hai Munker hai, imam Ahmed Bin Hammbel aur Bai’haqi ne Yahi Farmaya hai: ke Ibne Abbas ke Jumla Shagird Uske Khilaaf Riwayat karte Hain.[Nail-Al-Awtaar Jild 2 Safa 157] aur [Aa’laam Al-Muqaeen Jild 2 Safa 26] aur Fath Al-baari Safa 291]

(3) Allama Ibne Arabi Maaliki Sarah Tirmazi ne kaha ke Ye hadees ki Sehet main Kalam hai pes wo Ijma per Kaise Tarjeeh Pasakti hai [Fath Al-Baari Jild 9 Safa 291]

(4) Imam Shafa’I ne Fermya: ye Hukum Man’sookh hai [Nail-Al-Awtaar Jild 2 Safa 157 ]

(5) Is Riwayat ka Madaar  Tawoos Per Hai Aur Inki Nasab Allama Abu Jafer Bin Al-Nahas ne Kitaab Al-Naasikh wa Al-Mansookh Main Likha Hai ke Tawoos ager che Merd e Saaleh hain mager Ibne Abbas se Inki Kai Riwayaat munker wo na Qubool hain.[Al-Naasikh wa Al -Mansookh)

(6) Riwayat ka pura mazmoon Ghor se Padhe To Saaf Maloom hota Hai Ke, Hazrat Ibne Abbas (raz) ne khud Uska Jawab De’diya. Kabi Kisi Wajah se Aisa Hota Tha  Laikin Hazrat e Umer(raz) ke Zamane main Iske Khilaaf Per Ijma Hogaya Lehaza  Teen Talaq’on ke Baad Raja’at jayaz Nahi hai.

(7) Allama Qur’tubi ne Farmaya hai Ki Ye Riwayat Muztarab Hai. [Fath al-Baari Jild 9 Safa 292].

Bhot Ziyadh Qabil E Tawajjeh Baat Ye Hai Ke Tawoos Ne Hazret Ibne  Abbas (raz) se Naqal Kiya hai Aur Khud Ibne Abbas(raz) ne Iske Khilaaf Fatwe Diye hain.

[Mulahiza Hon Sunan Sa’eed Bin Mansoor Hadees No: 1064] aur (Musannaf Ibne Ibi  Shi’bha Jild 5 safa 11] Isse Maloom Hota hai Ke Yato Ye Riwayat Kisi Rawi Ka  Wahem Hai Jaisa Ke Ibne Abdul Ber Ka Khayal Hai, Ya Phir Mansookh Hai Ye  Kaise Hosakta hai Ke Hazrat Ibe Abbas (raz) Fata’we Nabi(sallallahu alahi wasallam)  ka Ilm Rakhte Hue Iske Khilaaf Fat’we De’den Phir Is se Badh Ker Ye ke Abu Al-Qhaba’E Jis Ki Shaksiyat Bilkul Majhool Hai Aur Bilkul Yaqini Hai Ke Wo Sahabi  Nahi Hai Isko To Maloom Tha Ke Ahede Nabawi(sallallahu alalihi wasallam) Wa  Aheade Siddqi Main Teen Talaq ek Thi Laikin Sahaba (raz) is Hukm Se Na Waqif  The ?

Werna Kiya Wajah Hai Ke Jab Hazrat e Umer(raz) ne Jab Teen’on ko Nafiz Kiya Aur Uska Ae’laan Farmaya To Kisi Sahabi ne Na Toka,? Kisi Ne Mukhlifat na ki Ya Kisi Ne Na Nataya Ke aheade SiddiQi Ke Khilaaf Hai? Ager Kisi Sahabi Ne Mukhalifat Ki ho To Koi Sahab Himmat Ker ke Unka Naam

Kaha han! Ap (sallallahu  alaihi wasallam) ne Fermaya Ke wo Ek Hi hain Ager Tumhara Ji Cha’he to Ruju’at  karlo [Musnad Ahmed]

Kaha Jata Hai Ki Ye Hadees Hasan Or Sahee Dono Tareeqe se Mar’vi hai, mager der  Haqeeq’at Ye Muga’letah hai, Hazrat e Rukana Ne Teen Talaq Nahi Di’thi Balke  LAFZ E BATTAH ke Saath Talaq Di Thi. Aur Panch(5) Jaleel Ul Qadr  Muhaddisoo’n Ne Talaq e Battah Wali Riwayat Ki Tasheeh Ki Hai. Pas Musnad Ahmed Wali Riwayat Sahi Ya Hasan Ho Sakti Hai?

Jab Rukana Ka Lafz E Battah Ke Saath Talaq Dena Muhadiseen Ke Nazdik Sahi  Waqe Hai To Phir Isi Waqe Main Teen Talaq Ka Waqe Hona Kon Sahi Keh Sakta  hai, Yahi Wajah Hai Ke Kisi Muhaddis Ne Musnad Ahmed Wali Riwayat Wali  Riwayat Ki Tehseeh Ya Tatheen Nahi Ki, Balke Muhaddiseen Ne Isko Had se Ziyada  Kamzoor(Za’eef) Bata Ya hai Chnan’che.

Musnad ahemed Wali Hadees Dawood ne Ikerama se Suni Aur Bayan ki hai Lehaza  Imam e Buqari Ke Ustaad Aur Abu Dawood ke Faisle Ke Mutabiq Ye Bhi  Munker (Inkaar ki Hui) hai, Aur Firqah E Naam Nihaad Ahele Hadees Ka Dawa Hai  ke Inki Daleel Sirf sahee Ahadees Hoti hain Is Liye Ye Za’eef Hadees Inke Liye nahi  Hosakti,

AASAAR:  Firqah e Naam Nihaad  Ke Nazdik Gair e Nabi Ka Qul o Fail  hujjat(Daleel) nahi hai Isliye Wo Daleel Main Aasaar Pesh Nahin Kersakte, Ager Wo  Daleel Main Aasaar Pesh Karte hain To Qabil e Qubool Nahi, Chunke Firqah e Naam Nihaad ke Paas Daleel Nahi hain aur wo Khud Apne Maslak  ki Kamzoori (za’eefi) Mehsoos Kerte Hain Is liye Is per Perdh daal ne ke’liye wo  Galat baya’noon se kaam lete hain, aur Keh’dete hain ke Hazrat e ali, abdul al-remaan  bin awoof, abu moo’sa ash’ari, aur Zuber, aur Jabir aur Diger bade bade Sahaba(rizwanullah alaihim ajmaeen)  Ikraam yahi Farmate hain(yani ek Maslis ki  Teen Talaq’on ko ek Kehte hain, jab ki Mukhalifeen ke Imam Jinke Inkeshaaf ki  Taqleed karrahe hain yani allama Ibne Qa’yyim(reh) ne [Agasila Al-lehfaan] main  nihayat Safai ke Saath Ye Likha Ke Hazrat ibne Abbas(raz) ke Siwa Kisi Aur Sahabi  se is Qaul Ki Naqal Sahi ham ko Maloom Nahi is Wajah se Ham ne Is ko Ikhtelaaf Ki  Wajah’hon main Shumaar kiya hi nahi [Agaa’siyh / 179] Dusri Galat Bayani ye Karte  Hain ke khete hain wo Hazat Ibne Abbas ka Yahi Mazhab hai, jabke Allama Ibne  Qa’yyim ne khud Iqraar Karte hain aur Tehqeq ke Hazrat Ibne Masood aur Hazrat e Ali  wa Ibne Abbas se Ikhatti Teen Talaq’on Ka Lazim kerna Bilaa Shek wo Subha ke Sabit hai,[Al-gaa’siyah / 179] Gerz apni Daleel main Firqah e Naam Nihaad Jitni  Riwayat Pesh karte hain wo Qabil e hujjat nahi.

Quran e Kareem Ka Sareeh Hukm,

Pas ager Usko (Teen) Talaq dede to uske Liye Halal nahi hai uske baad jabtet ke wo (aurat) Dusre se Nikaah na Karle.[sureh Al-Baqrah Ayat no: 230]
