Taqreer-E-Tirmizi Ki Ek Ibaarat Per Aitraaz Ka Jawaab

Baaqi post ka jawab sheikh ul hind mehmood ul hassan k is zuban e zad aam jumly me hy, masla khyar e majlis k mutaliq farmaty hen, haq or insaf ye hy k is masly me tarjih imam shafi k qoul ko hasil hy lakin hum abu hanifa k muqalid hen hum par unki taqled wajib hy, taqrer tirmizi, ye haq or insaf jan kar b abu hanifa ki taqled ko wajib kehny waly par kya fatwa hy?

Al-Jawaab:
Aitraaz waali Ibaarat ka Arabi Matan..

الحق والانصاف ان الترجيح للشافعي في هذه المسئلة ونحن مقلدون يجب علينا تقليد امامنا ابي حنيفة ـ

Kitaab (Taqreer Tirmizi) Sheikhul Hind Maulana Mehmood Al-Hasan (rahimahullah) ki Khud ki Taaleef nahi hai balke Unke Ek Shaagird ne unke aqwaal ko Tarteeb diya hai aur apna naam Makhfi (Hidden) rakha.

Is Aitraaz waali Ibaarat se pehle Ye Ibaarat bhi is Kitaab me maujood hai:

والحديث ليس بمصرح للترجيح بل المرحج القياس فنحن لا نرتكب خلاف الحديث بل نخالف قياس الشافعي وقياسه ليس بحجة علينا ـ ( تقرير ترمذي )

Aur Hadees TARJEEH KI SIRAAHAT NAHI KARTI balke MARJAH Qiyaas hai to Hum Hadees ke khilaaf ke Murtakab nahi balke Hum Imaam Shaafa’i (rahimahullah) ke Qiyaas ki Mukhaalifat karte hain, Aur Un ka Qiyaas hamaare Khilaaf Hujjat nahi….” [Taqreer Tirmizi, Safhah: 35]

Is Ibaarat ko aur Aitraaz waali Ibaarat ko milaaya jaaye to dono me Sareeh Ta’ruz hai.

Pas Saabit hai ke Mehmood Al-Hasan (rahimahullah) ke Shaagird ko Sahih baat Note karne me Ghalti hui hai.

Hum kehte hain Yehi mas’alah Unke doosre Shaagird Abdul Hafeez Bilyaavi (rahimahullah) ne bhi naqal kiya hai apni Kitaab [Taqaareer Sheikhul Hind Quddas Sirrah, Safhah: 143] me magar Unhoney Ye Aitraaz waali Ibaarat naqal nahi ki Jo [Taqreer Tirmizi] me maujood hai.

Shaagird Ki Ghalti Ka Ek Aur Saboot Mulaahizah Farmaayei’n:
Rafayadayn Ke Mas’alah me (Taqreer Tirmizi) me likha hai:

ان رفع اليدين كان مشروعا في اول الاسلام ثم نسخ شيئا فشيئا

“Be-shakk! Rafayadayn Ibtida-e-Islaam me Mashroo’ tha phir Thhora Thhora ho kar Mansookh hota raha.”

Lekin Ye Nazariyah Sheikhul Hind (rahimahullah) ki Khud ki likhi hui Kitaab [Eizaahul Adillah, Safhah: 14] ke khilaaf hai…
Likhte hain: “Hamaari is Taqreer se saaf Zaahir hai ke, Hum Ahaadees-e-Tark Rafa’ ko Naasikh Ahaadees-e-Rafa’ nahi kehte balke Ahaadees-e-Rafa’ me maujoodah 2 Ahtemaal
(1) Baqa’ Rafa’ wa
(2) Naskh Rafa’ maujood the.
Inme se Ek Ahtemaal ko Ahaadees-e-Tark ne Raajeh kar diya is per bhi Jo Aap Humse Daleel Naskh-e-Rafa’ Talab karte hain. Ye Aap ki Khush Fehmi hai hamaare Mud’aa ko Saboot-e-Naskh per mauqoof samajhna aur Hum ko Khwaah Makhwaah Mudda’i Naskh qaraar dena apne hi Ijtihaad ko batta laga dena hai.”

Pas saabit hua ke, Is Aitraaz waali Ibaarat ko note karne me Sheikhul Hind (rahimahullah) ke Shaagird se Ghalti hui hai.

Lihaaza is Haqeeqat ko Jaan lene ke ba’d Firqah Ahl-e-Hadees Ke Ulema’ wa Juhala’ ka is Ibaarat ko Peish kar ke Kuffaar ki tarah man-maani Tashreeh karna Dhoka wa Fareib ke siva kuch na hoga.
