AITRAAZ:-
(Naam Nihaad) Ahl-e-Hadees firqe ke Aalim Talibur Rahman Fiqh Hanafi ko badnaam karne ke liye, Ahadees ke khilaaf
saabit karne ke liye Yu’n Aitraaz karte hain…

ISLAAM ME DARINDO’N KI TIJAARAT:
Abu Mas’ood se rivaayat hai ke, Rasoolullah (sallallaahu alaihi wa sallam) ne Kuttey ki Qeemat, Laundi aur Jadugar ki Kamaayi se mana’ farmaaya hai. [Sahih Bukhari, Raqam#2237]

FIQH HANAFI ME DARINDO’N KI TIJAARAT:
Ab Ahnaaf ki bhi sun lijiye… Sahab-e-Hidayah likhte hain: “Kuttey, Sheir aur Darindey chaahe Sudhaaye (Trained) hue ho Ya Ghair Sudhaaye Unki Tijaarat Jaayez hai .” [Kya Fiqh Hanafi Qur’an Aur Hadees Ka Nachor Hai, Safah: 40]

AL-JAWAAB:-
Qaara’een-e-Kiraam.! Jawaab dene se pehle Ek Aham Nuktah per aap ki Tawajjah markooz karna chaahunga ke, Fuqaha-e-Ahnaaf ka Ye Tareeqah kaar raha hai ke Kisi bhi Mas’alah me Us Baab (Chapter) ke Ta’lluq ki Tamaam Ahaadees ko Peish-e-Nazar rakh kar Mas’alah ka hal nikaalte hain Jab ke Firqa-e-Jadeed (Naam Nihaad) Ahl-e-Hadees aisa nahi karte balke chand Matlab ki Ahaadees ki bunyaad per Mas’alah bayaan karte hain aur Log inke Fareib me phans jaate hain.

MAS’ALAH KI HAQEEQAT:
Imaam Abu Hanifah (rahmatullahi alaih) ka Mauqaf Ye hai ke Ahaadees me mazkoor (ﻧَﻬَﻰ) “Nahi” Us Zamaane se muta’lliq hai Jab Kutto’n ke baare me Shari’at ke Ahkaam bohat Sakht the aur iski wajah Ye thi ke Ahl-e-ARAB me Kutto’n ke liye bohat Zyadah Ins wa Muhabbat Paayi Jaati thi aur Unke Gharo’n me Kutto’n ko Shouq ke liye paalne ka Rivaaj tha.

Ye Ins wa Muhabbat aur Ta’lluq unke Dilo’n se nikaalne ke liye Shuru’ me bohat Sakht Ahkaam diye gaye Jo ke ba’d me Aahista Aahista Narm hote gaye aur Aakhir me Ye Hukm tehar gaya ke Kisi Zarurat ki gharz se Kuttay ko Paal lene ki Ijazat hai Lekin Shoqiyah taur par Kutta rakhne ki Ijaazat Nahi.

Ahaadees mulaahizah farmaayei’n…

(I):.. Ibn Mughaffal (raziallahu anhu) bayaan karte hain, “Rasoolullah (sallallaahu alaihi wasallam) ne (Ibtida’ me) Kutto’n ko Qatl karne ka Hukm diya, Phir farmaya: Kuttay Logo’n ko Kya Takleef dete hain.? Phir Aap (sallallaahu alaihi wa sallam) ne Shikaari Kuttay aur Bakriyo (ki Hifazat) ke liye Kutto’n ko paalne ki Ijaazat de di.” [Sahih Muslim]

ﻋَﻦْ ﺍﺑْﻦِ ﺍﻟْﻤُﻐَﻔَّﻞِ ، ﻗَﺎﻝَ : ” ﺃَﻣَﺮَ ﺭَﺳُﻮﻝُ ﺍﻟﻠَّﻪِ ﺻَﻠَّﻰ ﺍﻟﻠَّﻪُ ﻋَﻠَﻴْﻪِ ﻭَﺳَﻠَّﻢَ ﺑِﻘَﺘْﻞِ ﺍﻟْﻜِﻠَﺎﺏِ ” ، ﺛُﻢَّ ﻗَﺎﻝَ : ” ﻣَﺎ ﺑَﺎﻟُﻬُﻢْ ﻭَﺑَﺎﻝُ ﺍﻟْﻜِﻠَﺎﺏِ ” ، ﺛُﻢَّ ” ﺭَﺧَّﺺَ ﻓِﻲ ﻛَﻠْﺐِ ﺍﻟﺼَّﻴْﺪِ ، ﻭَﻛَﻠْﺐِ ﺍﻟْﻐَﻨَﻢِ ”

Is hadees me 3 baato’n ka Zikr hai:
1. Pehle Kutto’n ko Qatl karne ka Hukm tha.
2. Phir Qatl karne ka Hukm mansookh ho gaya.
3. Phir Shikaari Kuttay aur Bakriyo’n ki Hifaazat karne ke liye Kuttey paalne ki ijaazat de di gayi.

(II):.. Abu Hurayrah (raziallahu anhu) bayaan karte hain ke, Rasoolullah (sallallaahu alaihi wa sallam) ne farmaaya, “Jis shakhs ne Shikaar, Maweishi aur (Kheiti ki) Zameen ke alaawah Kutta Paala Ya Rakha to Us ke Ajar me se Har Roz 2 Qeeraat Kam hote rahenge.” [Sahih Muslim]

ﻋَﻦْ ﺃَﺑِﻲ ﻫُﺮَﻳْﺮَﺓَ ، ﻋَﻦْ ﺭَﺳُﻮﻝِ ﺍﻟﻠَّﻪِ ﺻَﻠَّﻰ ﺍﻟﻠَّﻪُ ﻋَﻠَﻴْﻪ ﻭَﺳَﻠَّﻢَ ، ﻗَﺎﻝَ : ” ﻣَﻦِ ﺍﻗْﺘَﻨَﻰ ﻛَﻠْﺒًﺎ ﻟَﻴْﺲَ ﺑِﻜَﻠْﺐِ ﺻَﻴْﺪٍ ، ﻭَﻟَﺎ ﻣَﺎﺷِﻴَﺔٍ ، ﻭَﻟَﺎ ﺃَﺭْﺽٍ ، ﻓَﺈِﻧَّﻪُ ﻳَﻨْﻘُﺺُ ﻣِﻦْ ﺃَﺟْﺮِﻩِ ﻗِﻴﺮَﺍﻃَﺎﻥِ ﻛُﻞَّ ﻳَﻮْﻡٍ ”

Is Hadees se bhi saabit hua ke In Teen Wajaho’n se Kutta paalne ki ijaazat hai. Aur Ye Ijaazat ba’d ke Zamaane hi ki hai Jis waqt Kutto’n ko Qatl karne ka Hukm mansookh ho chuka tha.

Note:- Ek Qeeraat Uhad ke Pahaad ke baraabar hota hai.

Qur’an-E-Paak me bhi Kuttey wagherah ke Shikaar ka Zikr milta hai.

(III):.. “To Khao Us Shikaar me se Jo Wo (Shikaari Kuttey wagherah) Maar kar Tumhaare liye rehne dei’n aur Us par Allah ka Naam lo.” [Surah Al-Maa’idah: 4]

Is aayat ki Tashreeh me Hadees bhi maujood hai..

(IV):.. Adi bin Haatim (raziallahu ta’la anhu) farmaate hain, Maine Poocha: Ae Allah ke Rasool (sallallaahu alaihi wa sallam) Main Allah ka naam le kar Sudhaaya hua Kutta Shikaar per Chhorta hoon Jo usko pakarta hai. To Farmaaya: Jab Tum Allah ka Naam le kar Sudhaaya hua Kutta Shikaar per Chhoro to Us ka Khaana Jaayez hai. Maine poocha: Agar Wo Us ko Qatl kar daale tab bhi.? Farmaaya: Haan agarchah Qatl kiya ho tab bhi jab tak ke Doosra Kutta (Jis per Allah ka naam nahi liya gaya ho) usme Shareek na hua ho. [Sahih Muslim]

ﻋَﻦْ ﻋَﺪِﻱِّ ﺑْﻦِ ﺣَﺎﺗِﻢٍ ، ﻗَﺎﻝَ : ﻗُﻠْﺖُ : ﻳَﺎ ﺭَﺳُﻮﻝَ ﺍﻟﻠَّﻪِ ، ﺇِﻧِّﻲ ﺃُﺭْﺳِﻞُ ﺍﻟْﻜِﻠَﺎﺏَ ﺍﻟْﻤُﻌَﻠَّﻤَﺔَ ، ﻓَﻴُﻤْﺴِﻜْﻦَ ﻋَﻠَﻲَّ ﻭَﺃَﺫْﻛُﺮُ ﺍﺳْﻢَ ﺍﻟﻠَّﻪِ ﻋَﻠَﻴْﻪِ ، ﻓَﻘَﺎﻝَ : ” ﺇِﺫَﺍ ﺃَﺭْﺳَﻠْﺖَ ﻛَﻠْﺒَﻚَ ﺍﻟْﻤُﻌَﻠَّﻢَ ﻭَﺫَﻛَﺮْﺕَ ﺍﺳْﻢَ ﺍﻟﻠَّﻪِ ﻋَﻠَﻴْﻪِ ، ﻓَﻜُﻞْ ” ، ﻗُﻠْﺖُ : ﻭَﺇِﻥْ ﻗَﺘَﻠْﻦَ ، ﻗَﺎﻝَ : ” ﻭَﺇِﻥْ ﻗَﺘَﻠْﻦَ ﻣَﺎ ﻟَﻢْ ﻳَﺸْﺮَﻛْﻬَﺎ ﻛَﻠْﺐٌ ﻟَﻴْﺲَ ﻣَﻌَﻬَﺎ ”

In rivaayaat ke peish-e-nazar Imaam Abu Hanifah (rahmatullahi alaih) farmaate hain ke, Jab Kisi Jaayez Zarooriyaat ke liye Kuttey ko Paalna aur Us se Faaydah uthaana Durust hai to Zaahir baat hai ke Uski Khareed-o-Farokht karna bhi Durust hai. Isi wajah se Jin ba’z rivaayaat me Kutto’n ki Khareed-o-Farokht se Mumani’at aayi hai wo Pehle daur ki hain aur ba’d me inhi rivaayaat me Istishna’ bhi saabit hai. Chunanchah dekhiye mandarjah zail rivaayaat…

(V):.. Jaabir bin Abdullah (raziallahu ta’la anhu) se rivaayat hai ke, Nabi (sallallahu alaihi wa sallam) ne Billi aur Kuttey ki Biya’ (Tijarat) se mana’ farmaaya sivaaye Shikaari Kuttey ki Biya’ se. [Sunan Nisaa’i, Raqam# 4674; Darqutni, Raqam# 2703, 2704, 2705; Musnad Ahmed# 14122; Sunan Kubra Bayhaqi]

ﺃَﺧْﺒَﺮَﻧِﻲ ﺇِﺑْﺮَﺍﻫِﻴﻢُ ﺑْﻦُ ﺍﻟْﺤَﺴَﻦِ ﺍﻟْﻤِﻘْﺴَﻤِﻲُّ ، ﻗَﺎﻝَ : ﺣَﺪَّﺛَﻨَﺎ ﺣَﺠَّﺎﺝُ ﺑْﻦُ ﻣُﺤَﻤَّﺪٍ ، ﻋَﻦْ ﺣَﻤَّﺎﺩِ ﺑْﻦِ ﺳَﻠَﻤَﺔَ ، ﻋَﻦْ ﺃَﺑِﻲ ﺍﻟﺰُّﺑَﻴْﺮِ ، ﻋَﻦْ ﺟَﺎﺑِﺮٍ ، ﺃَﻥَّ ﺭَﺳُﻮﻝَ ﺍﻟﻠَّﻪِ ﺻَﻠَّﻰ ﺍﻟﻠَّﻪُ ﻋَﻠَﻴْﻪِ ﻭَﺳَﻠَّﻢَ : ” ﻧَﻬَﻰ ﻋَﻦْ ﺛَﻤَﻦِ ﺍﻟﺴِّﻨَّﻮْﺭِ ، ﻭَﺍﻟْﻜَﻠْﺐِ ﺇِﻟَّﺎ ﻛَﻠْﺐَ ﺻَﻴْﺪٍ ”

Alfaaz ke Ikhtilaaf ke saath bhi marwi hai..

ﺣَﺪَّﺛَﻨَﺎ ﻋَﺒَّﺎﺩُ ﺑْﻦُ ﺍﻟْﻌَﻮَّﺍﻡِ ، ﻋَﻦِ ﺍﻟْﺤَﺴَﻦِ ﺑْﻦِ ﺃَﺑِﻲ ﺟَﻌْﻔَﺮٍ ، ﻋَﻦْ ﺃَﺑِﻲ ﺍﻟﺰُّﺑَﻴْﺮِ ، ﻋَﻦْ ﺟَﺎﺑِﺮِ ﺑْﻦِ ﻋَﺒْﺪِ ﺍﻟﻠَّﻪِ ، ﻗَﺎﻝَ : ” ﻧَﻬَﻰ ﺭَﺳُﻮﻝُ ﺍﻟﻠَّﻪِ ﺻَﻠَّﻰ ﺍﻟﻠَّﻪُ ﻋَﻠَﻴْﻪِ ﻭَﺳَﻠَّﻢَ ﻋَﻦْ ﺛَﻤَﻦِ ﺍﻟْﻜَﻠْﺐِ ، ﺇِﻟَّﺎ ﺍﻟْﻜَﻠْﺐَ ﺍﻟْﻤُﻌَﻠَّﻢَ ” .

Is Hadees ko Abi Zubair (rahimahullah) se rivaayat karne waale do Raavi hain Jo Ek doosre ki Mutaaba’t karte hain.

1. Hammaad bin Salmah (rahimahullah)
2. Hasan bin Abi Ja’far (rahimahullah).. [Musnad Ahmed]

Aur Hammaad bin Salamah (rahimahullah) se is ko rivaayat karne waale 5 Shaagird humei’n ma’loom hue hain.

1. Hajjaaj bin Muhammad.. [Sunan Tirmizi]

2. Ubaidullah bin Moosa.. [Sunan Darqutni]

3. Haisam bin Jameel.. [Sunan Darqutni]

4. Suweid bin ‘Amr.. [Sunan Darqutni]

5. Waahid bin Ghyaas.. [Sunan Kubra Bayhaqi]

Is Hadees ka Shaahid bhi maujood hai..

(VI).. Abu Hurayrah (raziallahu ta’la anhu) se rivaayat hai, farmaaya (Rasoolullah sallallahu alaihi wasallam) ne mana’ kiya Kuttey ki Qeemat se sivaaye Shikari Kuttey ke (Ya’ni Uski Qeemat ko mana’ nahi kiya). [Tirmizi, Raqam# 1198; Musannaf Ibn Abi Shaibah, Raqam# 20306; Darqutni]

ﺃَﺧْﺒَﺮَﻧَﺎ ﺃَﺑُﻮ ﻛُﺮَﻳْﺐٍ ، ﺃَﺧْﺒَﺮَﻧَﺎ ﻭَﻛِﻴﻊٌ ، ﻋَﻦْ ﺣَﻤَّﺎﺩِ ﺑْﻦِ ﺳَﻠَﻤَﺔَ ، ﻋَﻦْ ﺃَﺑِﻲ ﺍﻟْﻤُﻬَﺰِّﻡِ ، ﻋَﻦْ ﺃَﺑِﻲ ﻫُﺮَﻳْﺮَﺓَ ، ﻗَﺎﻝَ : ” ﻧَﻬَﻰ ﻋَﻦْ ﺛَﻤَﻦِ ﺍﻟْﻜَﻠْﺐِ ﺇِﻟَّﺎ ﻛَﻠْﺐَ ﺍﻟﺼَّﻴْﺪِ ” .

Alfaaz ke Ikhtilaaf ke saath bhi marwi hai..

ﺣَﺪَّﺛَﻨَﺎ ﺃَﺑُﻮ ﺑَﻜْﺮٍ ، ﻗَﺎﻝَ : ﺣَﺪَّﺛَﻨَﺎ ﻭَﻛِﻴﻊٌ ، ﻋَﻦْ ﺣَﻤَّﺎﺩِ ﺑْﻦِ ﺳَﻠَﻤَﺔَ ، ﻋَﻦْ ﺃَﺑِﻲ ﺍﻟْﻤُﻬَﺰَّﻡِ ، ﻋَﻦْ ﺃَﺑِﻲ ﻫُﺮَﻳْﺮَﺓَ : ” ﺃَﻧَّﻬُﻤَﺎ ﻛَﺮِﻫَﺎ ﺛَﻤَﻦَ ﺍﻟْﻜَﻠْﺐِ ﺇﻻ ﻛﻠﺐ ﺻﻴﺪ ”

Hadees ka Doosra Shaahid bhi maujood hai..

(VII).. Ibn Abbas (raziallahu ta’la anhu) se marwi hai ke Rasoolullah (sallallahu alaihi wasallam) ne Shikaari Kuttay ki Qeemat lene ki Rukhsat (Ijazat) di. [Musnad Imaam Al-A’zam Abu Haneefah (rahimahullah), Safah: 169]

رخص ﺭَﺳُﻮﻝُ ﺍﻟﻠَّﻪِ ﺻَﻠَّﻰ ﺍﻟﻠَّﻪُ ﻋَﻠَﻴْﻪِ ﻭَﺳَﻠَّﻢَ فى ﺛَﻤَﻦِ ﺍﻟْﻜَﻠْﺐِ الصيد

KUTTEY KI QADR WA QEEMAT:
Ye Ek Haqeeqat hai ke Shikaari Kuttey Badi Mehnat se paale jaate hain, Un per Rupya aur Waqt dono hi sarf hote hain. Neiz Gharo’n ki Hifaazat aur Kheit ki Hifaazat ke liye bohat se Log Kutto’n ko Paalna Apni Majboori wa Zaroorat samajhte hain.

(VIII).. “Abdullah bin ‘Amr bin Al-‘Aas (raziallahu ta’la anhu) ne Shikaari Kuttey ke baare me Faislah kiya Jis ko Ek Aadmi ne Qatl kar diya tha ke 40 dirham adaa’ kare aur Nigraani karne waale Kutte ke baare me Faislah kiya ke 1 Meindha adaa’ kare.” [Sunan Al-Kubra Bayhaqi, Raqam# 10185; Sharah Mu’anil Aasaar, Raqam# 3470]

ﻋَﻦْ ﻋَﺒْﺪِ ﺍﻟﻠَّﻪِ ﺑْﻦِ ﻋَﻤْﺮِﻭ ﺑْﻦِ ﺍﻟْﻌَﺎﺹِ ، ” ﺃَﻧَّﻪُ ﻗَﻀَﻰ ﻓِﻲ ﻛَﻠْﺐِ ﺻَﻴْﺪٍ ﻗَﺘَﻠَﻪُ ﺭَﺟُﻞٌ ﺑِﺄَﺭْﺑَﻌِﻴﻦَ ﺩِﺭْﻫَﻤًﺎ ، ﻭَﻗَﻀَﻰ ﻓِﻲ ﻛَﻠْﺐِ ﻣَﺎﺷِﻴَﺔٍ ﺑِﻜَﺒْﺶٍ ” .

(IX).. Imrān bin Abi Anas (rahimahullah) se rivaayat hai, “Usman (raziallahu ta’la anhu) ne Ek Shakhs per 20 Oont ka Taawaan daala Jisne Ek (Shikaari) Kuttey ko Qatl kar diya tha.” [Sunan Al-Kubra Bayhaqi, Raqam# 3117]

ﻋَﻦْ ﻋِﻤْﺮَﺍﻥَ ﺑْﻦِ ﺃَﺑِﻲ ﺃَﻧَﺲٍ ، ” ﺃَﻥَّ ﻋُﺜْﻤَﺎﻥَ ﺃَﻏْﺮَﻡَ ﺭَﺟُﻼ ﺛَﻤَﻦَ ﻛَﻠْﺐٍ ﻗَﺘَﻠَﻪُ ﻋِﺸْﺮِﻳﻦَ ﺑَﻌِﻴﺮًﺍ ”

Agar Shikaari Kuttey ki Koi Qadar wa Qeemat na hoti to aisa faislah Hargiz na farmaaya jaata. In rivaayaat me Shikaari Kuttey ki Biya’ (Tijarat) ki Ijaazat mazkoor hai Jab ke Kheiti, Ghar aur Bakri wagherah ke Muhaafiz Kuttey ki Khareed wa Farokht ki Ijaazat is par Qiyaas karne se Saabit hogi.

Aur Jo rivaayat Taalibur Rahman ne naqal ki hai Wo Pehle Daur ki hai
Jab Kutto’n ko Qatl karne ka Hukm tha. Jab Shikaar, Kheiti aur Maweishi ki Hifaazat ke liye Kutta rakhne ki Ijaazat ho gayi to Shikaari Kuttey ki Biya’ (Tijarat) ki Ijazat bhi ba’d me ho gayi thi.

Aur Aqal ka bhi Taqaazah Yehi hai ke, Agar Kisi ko Shikaari Ya Maweishi wa Kheiti ki Dekh bhaal ke liye Kuttey ki zaroorat pade to Us ko Khareed kar hi Laana padega.

Firqa Ahl-e-Hadees ko BHEEK maang kar Ya CHORI kar ke Shikaari Kutta laana Pasand hai to Isme Hamaara Kya Qusoor hai..?

Hum Ahnaaf to Hadees per hi amal karte hue Tijaarat karenge, Na Bheek maangenge aur Na hi Chori karenge.

Rasoolullah (sallallaahu alaihi wa sallam) ki Ahadees-e-Mubaarakah ko apni Khiyaanat me chhupaane waalo’n ko Ahl-e-Hadees kaha jata hai Ye dekh kar bada Afsos hota hai. Sach hai ke Munkareen-e-Hadees ka aadha kaam in (Naam Nihaad) Ahl-e-Hadeeso ne Aasaan kar rakha hai.

Allah Ta’ala se dua’ hai ke Humei’n DEEN ki Sahih Samajh ataa’ farmaaye. (Aameen Ya Rabbul ‘Aalameen)
